EXOi1BlT LEASE AGREEMENT THIS LEASE, is entered into as of the _ day of , 2008, by and between, Lakewood Senior Citizens, Inc. ("Landlord"), an Ohio Non-profit corporation, and the City of Lakewood Police Department ("Tenant"). WHEREAS, Landlord currently owns and operates a senior living complex commonly known as the "Westerly Apartments", located at 14300 Detroit Avenue, Lakewood, Ohio; WHEREAS, The City of Lakewood Police Department desires to lease a Studio Apartment (the "Apartment") within the Senior Living Complex from Landlord for use as a community policing office for the benefit of the citizens of the City of Lakewood; WHEREAS, Landlord wishes to lease the Apartment to the City of Lakewood Police Department for such use as a community policing office. NOW, THEREFORE, in consideration of the rent to be paid and the covenants to be performed by Tenant, Landlord hereby leases to Tenant, and Tenant hereby leases from Landlord, the Apartment. pursuant to the terms and conditions set forth herein below: 1. PARTIES Lakewood Senior Citizens, Inc. / dba Westerly Apartments 14300 Detroit Ave. Lakewood, OH 44107 City of Lakewood -Police Department 12650 Detroit Avenue Lakewood, OH 44107 2. DESCRIPTION OF APARTMENT -The Apartment which is leased hereunder is identified as Unit No. 116, is located on the 1 ~` floor, and consists of approximately 380 square feet. 3. TERM -This Agreement shall be month-to-month, beginning October 1, 2008, until terminated by either party. 4. RENTAL FEE -Tenant will pay the sum of $402 per month, as rental for the Apartment. One month's rent of $402 will be paid in advance. Rent is due by the 10`" day of each month. 5. CONDITIONS - CITY OF LAKEWOOD -Tenant agrees to comply with and carry out the following condition: A. Tenant will carry general liability insurance totaling $1,000,000.00 for the duration of the contract. This insurance policy will name Landlord as an additional insured. A copy of the insurance policy must be provided to Landlord by Tenant and will be placed on file in the Landlord's office. B. Tenant will properly secure and store all weaponry and other police equipment at Tenant's expense within the Apartment, including but not limited to the installation a locked cabinet in the Apartment to store firearms.
