Amended on the floor 11/3/08 ORDINANCE N0. 87-08 BY: Antonio, Bullock, Butler Dever, Madigan, Powers, Summers. AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise; it shall take effect and be in force after the earliest period allowed by law, amending section 905.02, Hours Open to the Public, of the Codified Ordinances of the City for purposes of removing the reference to specific picnic pavilions and to remain consistent with Section 905.15, Picnic Areas; Permit for use of Picnic Pavilions. WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that these changes are necessary to keep sections within Chapter 905, Parks consistent. Now Therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 905.02, Hours Open to the Public, of the Codified Ordinances of the City of Lakewood, currently reading as follows: 905.02 HOURS OPEN TO PUBLIC. (a) Parks shall be open daily for use by the general public. (b) Except as provided in subsection (e) hereof, no person other than an on- duty employee of the City shall enter into or remain within the limits of Lakewood Park, Madison Park or Kaufman Park between the hours of 11:00 p.m. and sunrise. (c) No person other than an on-duty employee of the City shall enter into or remain within the limits of Webb Park, Wagar Park, Edwards Park or Cove Park, during the time from one hour after sunset to sunrise. (d The Kiwanis Pavilion and the Shelter House Pavilion situated at Lakewood Park shat be open for use by permit holders from June 1 through September 30 of each calendar year between the hours of 8:00 a.m .and 10:00 p.m. daily. (e) No person, other than an on-duty employee of the City, shall enter into or remain within that area of Lakewood Park, north of the existing most northerly fence line, between the hours of 11:00 p.m, and 6:00 a.m. of the following day, and at such times as the Superintendent of the Division of Parks and Public Grounds deems it necessary due to special events and/or weather conditions. Special permission may be granted, in writing, by the Director of Public Safety or the Director of Public Works, to persons to use this area. shall be and is hereby amended to read as follows:
