WHEREAS, the existence of certain hazardous conditions may require a structure to be vacated, including but not limited to, danger of structural col- lapse, inadequate heat or use of dangerous heating mechanism, danger of fire, and lack of plumbing in safe working order; and WHEREAS, this Council by a vote of at least five (5) members elected the- reto determines that this ordinance is an emergency measure, and that this ordi- nance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and because population loss and economic decline experienced by the City in recent years has caused the incidence of vacant, open, or abandoned structures to increase significantly and that such structures cause a decrease in neighboring property values. Now therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, IN THE COUNTY OF CUYAHOGA AND STATE OF OHIO: Section 1. That new Section 1306.521, Public Nuisance Buildings and Structures; Repair or Demolition Thereof, is hereby enacted to read as follows: 1306.521 Public Nuisance Buildings and Structures; Re- pair or Demolition Thereof (a) Public nuisance structures defined. For the purposes of this Building Code, °public nuisance structures" are hereby defined as those buildings or struc- tures that are any of the following: (1) injurious to or a menace to the public health, safety or welfare; (2) structurally unsafe, unsanitary or not provided with adequate safe egress; (3) afire hazard; (4) vacant and open to public entry; (5) otherwise dangerous to human life or injurious to the public; or
