(ti) in relation to existing use, a hazard to the public <br />health, safety or welfare by reason of inadequate <br />maintenance, dilapidation, obsolescence or abandon- <br />ment. <br />(b) Unsafe structures. <br />(1) For the purposes of this Building Code those buildings <br />or structures that meet the definition of public nui- <br />sance structures are declared to be "unsafe struc- <br />tures" as well. <br />(2) All unsafe structures or conditions as defined in other <br />parts of the code are likewise declared to be public <br />nuisance structures under this code section. <br />(c) Per se public nuisance structures. <br />Vacant and unsafe structures in which utility services have <br />not been shut off are declared to be a public nuisance be- <br />cause of the risk of harm from explosion, accidental fire or <br />flooding. <br />Section 2. That new Section 1306.522, Declaration of Public Nuisance; <br />Repair or Demolition of Unsafe Structures and Exterior Property Nuisances; Viola- <br />tions and Remedial Notices; Appeals Process; Cost Recovery, is hereby enacted <br />to read as follows: <br />1306.522 Declaration of Public Nuisance; Repair or De- <br />molition of Unsafe Structures and Exterior Properly Nui- <br />sances; Violations and Remedial Notices; Appeals Process; <br />Cost Recovery. <br />(a) Declaration of public nuisance. <br />All public nuisance structures are declared to be public nui- <br />sances. The public nuisance shall be abated by correction of <br />the violations to the minimum standards of the Codified Or- <br />dinances of Lakewood, Ohio, the Revised Code and the Ohio <br />Administrative Code, including the Ohio Fire Code, or by <br />demolition. <br />(b) Examination and condemnation. <br />
