B. If the repair work ordered in compliance with the order to repair and citation is not completed within the time specified, the Director of Public Works may assess, in addition to the charges for repair, a civil fine of one hundred dollars ($100 00) upon the property owner so cited. C. If the fine set forth above is not paid in full within thirty days from the issuance of written notice of such fine to the property owner, or in the event any charges due for repair are not paid in a timely manner by the property owner, either directly or by assessment upon property 'taxes in accordance with these Codified Ordinances and general laws of the State of Ohio, the Director of Law may take such action as is determined appropriate to collect such fine or costs of repair. 903.99 PENALTY, (a) Whoever violates Section 903.08 shall be fined not less than ten dollars ($10.00) nor more than one hundred dollars ($100.00). b) Whoever violates Section 903.09 shall be fined not more than fifty dollars ($50.0 ). shall be and is hereby amended to read as follows: 903.01 COMPLIANCE WITH SIDEWALK SPECIFICATIONS In order to have all sidewalks in the streets and alleys within the City constructed and repaired in a reasonably uniform manner all such sidewalks hereafter to be laid and all repairing hereafter to be done shall be done in conformity with the requirements of this chapter. 903.02 SIDEWALK CONFORMITY TO STREET GRADE; EXCEPTION. All sidewalks shall be laid to conform to the established grade of the street and shall slope so as to coincide with the following described line: beginning at the top of the curb at the established grade and extending thence to the fence line or property line at an incline upward from such curb at the rate ofthree-eights of an inch for each. foot. At street intersections where the grade of streets renders such slope impracticable,. the sidewalks shall be laid under the direction and to the acceptance of the City Engineer or designee. For the replacement or repair of segments of sidewalk where the abutting sidewalk does not have the prescribed incline, the sidewalks shall be laid under the direction and to the acceptance of the City Engineer or designee. 903.03 SIDEWALK WIDTHS. On all streets and alleys of not less than thirty-three or more than forty feet in width, the sidewalks shall be not less than four feet wide. On all streets not less than forty nor more than sixty feet in width all sidewalks shall be not less than five feet wide. On all streets more than sixty feet wide and on all main streets or east and west thoroughfares, except Clifton Boulevard, all sidewalks shall be not less than six feet wide. However, on any street which is not a main street or an east and west thoroughfare, but is nevertheless devoted entirely to residences, the sidewalks shall be not less than five feet wide. On Clifton Boulevard, all sidewalks shall be not less than five feet wide Where trees within the public right of way render it impossible or impractical for the sidewalks to be constructed in accordance with the above prescribed sidewalk widths, such sidewalks shall be constructed under the direction of and to the acceptance of the Director of Public Works.
