ORDINANCE N0. 86-09 BY: Bullock, Butler, Dever, Madigan, <br />Powers, Summers. <br />AN ORDINANCE to take effect immediately provided it receives the <br />affirmative vote of at least five (5) members elected to Council otherwise, it shall <br />take effect and be in force after the earliest period allowed by law, to amend <br />Section 533.17 Prohibitions on Residency, of the Codified Ordinances of the City <br />of Lakewood to update and include changed designations under the State Code <br />requirements for the registration of sex offenders. <br />WHEREAS, at the time that Lakewood Codified Ordinance §533.17 was <br />.adopted by this Council, the Ohio Revised Code classified individuals who are <br />required to register under sexual offender registration and notification laws as <br />"sex offender", "habitual sex offender" or "sexual predator"; and <br />WHEREAS, the classifications of those who have committed sex offenses <br />has been changed within the Ohio Revised Code to "Tier 1 sex offender", "Tier II <br />sex offender" and "Tier III sex offender"; and <br />WHEREAS, the Ohio General Assembly has adopted legislation that <br />prohibits registered sex offenders from living within 1,000 feet of a preschool or <br />daycare in addition to the prior existing prohibitions; and <br />WHEREAS, this Council by a vote of at least five (5) members elected <br />thereto determines that this ordinance is an emergency measure, and that this <br />ordinance shall take effect at the earliest date possible as set forth in ARTICLE <br />III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it is necessary for the immediate preservation of the public <br />property, health and safety, and to provide for the usual daily operation of <br />municipal departments in that it is imperative to the enforcement of Lakewood's <br />local code to update these references so that they match designations contained <br />in the Ohio Revised Code. Now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That Section 533.17, Prohibitions' on Residency, of the <br />Codified Ordinances of the City of Lakewood, currently reading as follows: <br />
