533.17 PROHIBITIONS ON RESIDENCY, <br />(a) It is unlawful for any person who is required to register as a <br />sexually oriented offender under Ohio R.C. 2950.04 and classified as a <br />"sexual predator" or whose conviction was of a'~child-victim oriented <br />offense" as those terms are defined by Ohio R.C. 2950.01, to reside within <br />one thousand (1,000) feet of a school, library, park or municipally owned <br />recreation facility. <br />(b) Any person who violates this section is guilty of a <br />misdemeanor in the first degree. <br />(c) This section applies to any person registering on or after the <br />effective date of this legislation <br />shall be and is hereby amended to read as follows: <br />533.17 PROHIBITIONS ON RESIDENCY. <br />(a) It is unlawful for any person who is required to register as a <br />sexually oriented offender under Ohio R.C. 2950.04 and classified as a <br />"Tier III sex offender" or whose conviction was of a'~child-victim <br />oriented offense" as those terms are defined by Ohio R.C. 2950.01, to <br />reside within one thousand (1,000) feet of a school, preschool, Child <br />day-care, library, park or municipally owned recreation facility. <br />(b) Any person who violates this section is guilty of a <br />misdemeanor in the first degree. <br />(c) This section applies to any person registering on or after the <br />effective date of this legislation. <br />Section 2. That this ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health, safety and welfare in the City and for the usual daily operation of the City for <br />the reasons set forth and defined in the preamble to this ordinance, and provided it <br />receives the affirmative vote of at least five (5) of its members elected to Council, this <br />ordinance shall take effect and be in force immediately upon its adoption by the Council <br />and approval by the Mayor otherwise, it shall take effect and be in force after the <br />earliest period allowed by law. <br />
