A person who is issued a citation for <br />a violation of Section 331.38(a) is not permitted to enter a written plea of guilty and <br />waive his or her right to contest the citation in a trial, but instead must appear in <br />person in the proper court to answer the charge. <br />(ORC 4511.99(G)) <br />(13) Placing dangerous materials on streets. Whoever violates Section <br />311.01(e) is guilty of a misdemeanor of the first degree. (ORC 4511.99(K)) <br />(14) Motorized bicycles. Whoever violates any of the provisions of Section <br />373.14 is guilty of a minor misdemeanor, in addition to the revocation of probationary <br />motorized bicycle licenses for violations of Section 373.14(a) and (b), as provided in <br />Ohio R.C. 4507.163. Whoever is convicted of or pleads guilty to a violation of the <br />Traffic Code shall be imprisoned for a definite term or fined, or both, which term of <br />imprisonment and fine shall be fixed by the court as provided in Section 2929.21 of the <br />Ohio Revised Code. <br />(c) Construction Zone Violations. Notwithstanding subsection (b) hereof, upon <br />a finding that any person referred to in subsection (a)(1) hereof or Section 333.99(a) <br />has operated a motor vehicle in violation of this Traffic Code, in a construction zone <br />where a sign was then lawfully posted, the court in addition to all other penalties <br />provided by law, shall impose a fine of two times the usual amount imposed for the <br />violation. No court shall impose a fine of two times the usual amount imposed for the <br />violation upon an offender who alleges, in an affidavit filed with the court prior to his <br />sentencing, that the offender is indigent and is unable to pay the fine imposed pursuant <br />to this subsection, provided the court determines the offender is an indigent person and <br />is unable to pay the fine. Firemen, <br />when at the scene of a fire, may direct or assist the police in directing traffic thereat or <br />in the immediate vicinity. The direction of traffic may be by word or audible signal, by <br />gesture or visible signal or by any combination thereof.
