(b) No parent, guardian or legal custodian of a minor person who engages in <br />conduct prohibited by subsection (a) shall create a substantial risk to the health or <br />safety of such minor person by aiding, abetting, causing, encouraging or permitting <br />such conduct. Whoever violates this section shall be required to attend an authorized <br />helmet safety workshop with the offending minor. Whoever violates this subsection, <br />on a second offense, shall be fined in an amount not to exceed twenty-five dollars <br />($25.00). For each and every subsequent violation of this subsection, a Fine not to <br />exceed fifty dollars ($50.00) shall be imposed. <br />(c) The Court may dismiss all charges pursuant to this section upon presentation <br />of evidence that a violator hereof has purchased or obtained a protective helmet which <br />meets or exceeds the standards set forth herein subsequent to the violation. <br />(d) Failure to wear a protective helmet as herein described shall not be <br />considered evidence of either comparative or contributory negligence in any civil suit <br />arising out of any accident in which a person under eighteen years of age is injured, nor <br />shall failure to wear a protective helmet be admissible as evidence in the trial of any <br />civil action. <br />(Ord. 29-96. Passed 2-18-97.) <br />311.04 ZONES OF QUIET. <br />Whenever authorized signs are erected indicating a zone of quiet, no person <br />operating a vehicle within any such zone shall sound the horn or other warning device <br />of such vehicle except in an emergency. <br />shall be and is hereby amended to read as follows: <br />311.01 PLACING INJURIOUS MATERIAL OR OBSTRUCTION IN STREET. <br />(a) No person shall place or knowingly drop upon any part of a street, <br />highway or alley any tacks, bottles, wire, glass, nails or other articles which may <br />damage or m~ure any person, vehicle or animal traveling along or upon such street, <br />except such substances that may be placed upon the roadway by proper authority for <br />the repair or construction thereof. <br />(b) Any person who drops or permits to be dropped or thrown upon any <br />street any noxious, destructive or injurious material shall immediately remove the same. <br />(c) Any person authorized to remove a wrecked or damaged vehicle from a <br />street shall remove any glass or other injurious substance dropped upon the street from <br />such vehicle. <br />(d) No person shall place any obstruction in or upon a street without proper <br />authority. <br />(e) No person, with intent to cause physical harm to a person or vehicle, shall <br />place or knowingly drop upon any part of a highway, lane, road, street or alley any <br />tacks, bottles, wire, glass, nails or other articles which may damage or inure any <br />person, vehicle or animal traveling along or upon such highway, except such substances <br />that may be placed upon the roadway by proper authority for the repair or construction <br />
