thereof. <br />(f) (1) Except as otherwise provided in this subsection, whoever violates <br />any provision of subsections (a) to (d) of this section is guilty of a <br />minor misdemeanor. If, within one year of the offense, the <br />offender previously has been convicted of or pleaded guilty to one <br />predicate motor vehicle or traffic offense, whoever violates any <br />provision of subsections (a) to (d) of this section is guilty of a <br />misdemeanor of the fourth degree. If, within one year of the <br />offense, the offender previously has been convicted of two or more <br />predicate motor vehicle or traffic offenses, whoever violates any <br />provision of subsections (a) to (d) of this section is guilty of a <br />misdemeanor of the third degree. <br />(2) Whoever violates subsection (e) of this section is guilty of a <br />misdemeanor of the first degree. (ORC 4511.74) <br />3:11.02 PLAYING IN STREETS. <br />(a) No person shall slide or coast upon hand sleds or skates in any street of the <br />City. However, nothing in this section shall prohibit the setting aside of streets or <br />sections thereof, for limited periods of time, for playground purposes by the officials of <br />the City having charge thereof, under proper supervision. <br />(b) No person shall fly a kite or play any game of ball or quoits or other game, <br />on any street of the City. However, nothing in this section .shall prohibit the setting <br />aside of streets, or sections thereof, for limited periods of time, for playground purposes <br />by the officials of the City having charge thereof, under proper supervision. <br />311.03 TOY VEHICLES ON STREETS. <br />(a) No person on roller skates or riding in or by means of any sled, toy <br />vehicle, skateboard or similar device shall go upon any roadway except while crossing a <br />street on a crosswalk and except on streets set aside as play streets. <br />(b) Whoever violates this section is guilty of a minor misdemeanor on a first <br />offense; on a second offense within one year after the first offense, the person is guilty <br />of a misdemeanor of the fourth degree; on each subsequent offense within one year <br />after the first offense, the person is guilty of a misdemeanor of the third degree. <br />311.031 HELMETS FOR PERSONS OPERATING BICYCLES, SKATEBOARDS, <br />ROLLER-SKATES OR IN-LINE SKATES. <br />(a) No person under the age of eighteen shall operate a bicycle, skateboard, <br />roller- skates or in-line skates within the City unless the person is wearing a protective <br />helmet on their head, with the chin strap fastened under the chin. Such helmet shall be <br />fitted to the size of the operator. This requirement shall also apply to a person who <br />rides upon a bicycle while in a restraining seat which is attached to the bicycle or in a <br />trailer towed by the bicycle. This subsection shall not be applicable to the operation of <br />bicycles, skateboards, roller-skates or in-line skates on private residential property. <br />(b) No parent, guardian or legal custodian of a minor person who engages in <br />conduct prohibited by subsection (a) shall create a substantial risk to the health or <br />safety of such minor person by aiding, abetting, causing, encouraging or permitting <br />such conduct.
