Placed on first reading & referred to the <br />Rules and Ordinances Committee 9/6/11, <br />second reading 9/19/11; recommended for <br />adoption 10/3/11; please substitute for <br />the original. <br />ORDINANCE NO.41-11 BY: Anderson, Bullock, Juris, <br />Madigan, Nowlin, Powers, Smith. <br />AN ORDINANCE modifying Secfions 149.15, 516.03, 771.01, 771.02, 771.04, <br />771.06, 771.07, 771.08, 901.02, 902.09, 1783.12 and 1783.13 and repealing Chapter 761 <br />of the Lakewood Codified Ordinances to modernize the code by revising or eliminating <br />outmoded titles and other language. <br />WHEREAS, the Lakewood Codified Ordinances contain several titles and de- <br />scriptions of city officials that, over time, have become obsolete and stand to be replaced <br />with titles and descriptions that match the current organizational structure of Lakewood <br />municipal government; and <br />WHEREAS, Sections 149.15, 771.02, 771.04, 771.06, 771.07 and 771.08 of the <br />Codified Ordinances place certain responsibilities into the hands of a Superintendent of <br />the Division of Parks and Public Grounds or a Parks Superintendent, an official the City <br />does not otherwise ordain; and <br />WHEREAS, Section 516.03 places certain responsibilities into the hands of a Di- <br />rector of Community Development, an official the City has not ordained of late; and <br />WHEREAS, Chapter 761 of the Lakewood Codified Ordinances, Smoke, which <br />regulates construction and operation of furnaces and combustion devices and the emis- <br />sion of smoke, and which requires the oversight of an obsolete Smoke Inspector within <br />the Division of Smoke Inspection and Regulation, is no longer necessary as such issues <br />are now regulated by the Ohio and United States Environmental Protection Agency, and <br />all similar language in the charter has long since been repealed by the citizens of Lake- <br />wood; and <br />WHEREAS, Sections 771.01, 771.06, 771.07 and 901.02 of the Lakewood Codi- <br />fied Ordinances place certain responsibilities into the hands of a Division of Permits, a <br />division the City otherwise does not ordain; and <br />WHEREAS, Section 902.09 of the Lakewood Codified Ordinances places certain <br />responsibilities into the hands of a Water Department Superintendent, anofficial the City <br />does not ordain; and <br />WHEREAS, Sections 1783.12 and 1783.13 of the Lakewood Codified Ordinances <br />places certain responsibilities into the hands of a Service Director or Director of Service, <br />an official the City does not ordain; and <br />
