WHEREAS, websites on the Internet, and particularly websites designed to be of local <br />interest such as the City's website, www.onelakewood.com, aze places at which the public seeks <br />and fords information of public concern to those interested in Lakewood government; and <br />WHEREAS, in 2006 City Council passed Ord. 126-05, limiting information in public no- <br />tices to basic information while "referring to the specific location on the City's web pages for ... <br />detail," thereby recognizing the ability of the City's website to publish materials too voluminous <br />to print and recognizing that the City's website is a "location"; and <br />WHEREAS, in 2007 City Council passed Ord. 38-07, permitting the Director of Finance <br />to sell used city equipment at Internet auctions, thereby acknowledging that online auctions spe- <br />cifically will attract more interested parties to the city's offerings; and <br />WHEREAS, in 2009 City Council passed Ord. 28-09, requiring the Director of Public <br />Works to publish the City's mandatory recycling guidelines on the City's official website, <br />thereby accepting the resourcefulness of the online posting of citywide policy; and <br />WHEREAS, in 2010 City Council passed Ord. 23-10, rewriting the City's parking infrac- <br />tion code to permit, among other things, those charged with a parking violation to respond to the <br />charge either in person or over the Intemet, thereby recognizing that transacting city business by <br />the Internet is a viable alternative to meeting in person; and <br />WHEREAS, the evidence from within city hall, the police headquarters and the fire sta- <br />tions suggests that the public is no longer interested in reviewing posted materials at those loca- <br />tions in any measurable way; and <br />WHEREAS, thus in the digital age Council fords there is great utility in permitting the <br />posting of "the enactment of any and all ordinances, resolutions or other acts, procedures, state- <br />ments, including financial statements, or reports" both at city hall and on the Internet, as doing so <br />permits City Council and the administration to save the time and expense of wasted paper and <br />staffresources;and <br />WHEREAS, all powers of Council may be exercised by ordinance or resolution, so long <br />as they are not prohibited by the Second Amended Charter; and <br />WHEREAS, this Council by a vote of at least five (5) of its members determines that this <br />ordinance is an emergency measure; that it shall take effect on January 1, 2012, the effective date <br />of the charter amendment, as set forth in Article III, Sections 10 and 13 of the Second Amended <br />Charter of the City of Lakewood; and that it is necessary in order to immediately provide for the <br />peace and order of municipal operations by ending a costly and time-consuming practice; now, <br />therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1.
