1306.43 HOUSING LICENSE. <br />(a) No person shall let, rent, lease, conduct, operate, occupy, maintain or <br />own any building or portion of any building in which there is one or <br />more rental dwelling units or in which a rooming house is operated, or <br />own any interest therein, unless a housing license as provided in this <br />chapter has been applied for, issued and is in force.. <br />(b) Condominium property as the same is defined in Ohio R.C. Chapter <br />5311, shall be required to obtain a housing license as provided herein, <br />which license shall be obtained by the owner of the condominium <br />property, or by the unit owners association at such time such associa- <br />tionhas been formed. <br />shall be and is hereby amended to read as follows: <br />1306.43 HOUSING AND VACANT PROPERTY LICENSE. <br />(a) Application. This section applies toy. <br />(1) any stmcttire or portion of any structure in which there is one <br />or more rental dwelling units or in which a rooming house is <br />operated, whether occupied or not; <br />(2) condominium property as defined in Chapter 5311 of the Re- <br />vised Code, whether occupied or not, in which case the owner <br />of the condominium property or the unit owners association <br />shall be required to obtain the housing license as provided <br />herein; and <br />(3) vacant dwelling structures or commercial structures, whether <br />rental property or not.. <br />(b) Limitations. This section does not apply to lawful one- and two-family <br />structures occupied in part or wholly by the owner as the owner's prin- <br />cipal residence. <br />(c) In general.. <br />(1) No person shall rent or cause to be rented a dwelling unit or a <br />portion of a dwelling unit to another unless the person has <br />been issued a housing license as provided for in this section.. <br />(2) No owner of a structure shall maintain or cause to be main- <br />tained the structure in a vacant or abandoned status as defined <br />in Section 1306.72 without having been issued a vacant prop- <br />ertylicense as provided for in this section. <br />(3) No person in control of a property other than an owner, in- <br />cluding but not limited to a mortgagee, property holding com- <br />pany, property manager or lienholder, shall maintain the prop- <br />erty in a vacant or abandoned status as defined in Section <br />1306.72 without having been issued a vacant property license <br />as provided for in this section. <br />
