SECOND READING <br />12/5/11. <br />ORDINANCE NO. 53=11 gy; Anderson, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect on January 1, 2012, provided it receives the vote <br />of at least five (5) members of Council, or otherwise to take effect at the earliest period <br />allowed by law, repealing Section 149.13 and modifying Sections 149.14 and 149.141 of <br />the Lakewood Codified Ordinances to modernize the code by revising or eliminating <br />outmoded language regarding hospitalization coverage for employees. <br />WHEREAS, the City has put into place in its budgeting and administrative prac- <br />tices and has negotiated in its collective bargaining agreements updated contribution per- <br />centages for employees who are part of the City's hospitalization and medical benefits <br />plans; and <br />WHEREAS, faced with additional budget constraints, the City cannot any longer <br />afford to pay employees who do not participate in the City's hospitalization and medical <br />benefits plans; and <br />WHEREAS, the City no longer administers or participates in nonprofit hospital <br />service plans; and <br />WHEREAS, it is necessary and appropriate to update the Lakewood Codified Or- <br />dinances to reflect these changes; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Re- <br />vised Code, municipalities have the power to enact laws that are for the health, safety, <br />welfare, comfort and peace of the citizens of the municipality; and <br />WHEREAS, this Council by a vote of at least five (5) of its members determines <br />that this ordinance is an emergency measure and that it shall take effect on January 1, <br />2012, as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the <br />City of Lakewood and that it is necessary for the immediate preservation of the public <br />property, health, and safety and to provide for the usual daily operation of municipal de- <br />partments, in that the City wishes to have the updated code in plane prior to the 2012 fis- <br />cal year; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Section 149.13 of the Lakewood Codified Ordinances, currently read- <br />ing as follows: <br />149.13 SALARY DEDUCTIONS FOR HOSPITALIZATION INSUR- <br />ANCE. <br />The Director of Finance pursuant to Ohio R.C. 1739,15, is hereby author- <br />ized to deduct from the salaries or wages of any municipal employee sub- <br />scribing to any nonprofit hospital service plan, incorporated and operating <br />rnu <br />
