PLACED ON 1ST READING & REFERRED TO <br />THE HOUSING COMMITTEE 12/19/11. <br />PLACED~~ON 2ND READING 1/3/12. <br />ORDINANCE NO. 68-11 BY: Anderson, Bullock, Juris, <br />Dtadigan, Nowlin, Powers, Smith. <br />AN ORDINANCE repealing Chapter 1310, Residential Code for One, Two and Tluee <br />Family Dwellings, to be consistent with the City of Lakewood's state certification and current <br />Ohio law. <br />WHEREAS, The City of Lakewood is certified to enforce the Residential Code of Ohio; <br />and <br />WHEREAS, Chapter 1310 is in conflict with Ohio law and the City's state certification; <br />and <br />WHEREAS, the City may by its legislation exercise all powers of local self-govermnent <br />and adopt and enforce within its limits such local police, sanitary and similar regulations as are <br />not in conflict with general laws; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Chapter 1310, currently reading as follows: <br />CIIAPTER 1310 <br />Residential Code For One, Two and Three Family Dwellings <br />1310.01 PTTRPOSE AND ADOPTION. <br />Pursuant to the Ohio Revised Code 731.231, there is hereby adopted for the <br />purpose of establishing Rules and Regulations for the erection, constmction, <br />enlargement, alteration, repair, improvement, removal, conversion, demolition, <br />equipment, use, occupancy, or maintenance of one, two and three-family <br />dwelling houses which are not constmcted as industrialized units, and their <br />accessory structures, that a certain Code known as the International Residential <br />Code, 2000 Edition, published as a nationally recognized model code by the <br />Tnternational Code Council, hrcluding Appendix Chapters A, B and C thereto, <br />except such portions as are hereinafter deleted, modified or amended. A <br />complete copy of such Code shall be kept on file at the office of the Building <br />Commissioner and at the Lakewood Public Library. <br />1310.02 CONFLICTS OF LAWS. <br />In the event of any conflict behveen the requirements of the 2000 International <br />Residential Code, hereby known as the Residential Code for One, Two and <br />Tluee Family Dwellings, and the Regional Dwelling House Code, as adopted in <br />Chapter 1301 of the Codified Ordinances of the City of Lakewood or any <br />provision of any other City ordinance or technical code adopted by the City, the <br />more restrictive or specific provision shall govern. <br />1310.03 AMENDMENTS, ENACTMENTS OR REPEALS. <br />
