PLEASE SUBSTITUTE FOR ORDINANCE .0. <br />NO. 32-12 PLACED ON 1ST READING <br />&~AEFERRED TO THE HOUSING COMMITTEE <br />6/4/12, 2ND READING 6/18/12. <br />ORDINANCE NO. 32-12 <br />BY: Andreson, Bullock, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect inunediately provided it receives the affirmative <br />vote of at least five (5) members of Council, or otherwise to take effect and be in force <br />after the earliest period allowed by law, amending Section 741.071, Display for Sale of <br />Household Goods and Furnishings fi•om Nonretail Occupancies, of the Codified Ordi- <br />nances ofthe City of Lakewood to establish regulations for yard and garage sales. <br />WHEREAS, Section 741.071 of the Lakewood Codified Ordinances offers some <br />but little restriction of yard and garage sales and thus stands to be amended to create more <br />clarity for residents desiring to host such sales; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self-government and to adopt and enforce <br />within their limits such as local police, sanitary and other regulations as ate not in conflict <br />with general laws; and <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall take <br />effect at the earliest date possible as set forth in Article III, Sections 10 and 13 of the Se- <br />cond Amended Charter of the City of Lakewood, and that it is necessary to provide for <br />the usual daily operation of municipal departments iu that the yard and garage sale season <br />is upon us; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OIIIO: <br />Section 1. Section 741.071, Display for Sale of Household Goods and Furnish- <br />ings from Nonretail Occupancies, of the Codified Ordinances of the City of Lakewood, <br />currently reading as follows: <br />741.071 DISPLAY FOR SALE OF HOUSEHOLD GOODS AND <br />FURNISHINGS FROM NONRETAIL OCCUPANCIES. <br />(a) No person shall display for sale, any household goods, furnishings <br />or personal effects, including clothing, in any area of nonretail oc- <br />cupied premises upon which such goods are displayed other than <br />from the rear yard as defined in Section I (03.02(ccc) of the Ton- <br />ing Code and/orthe garage, if any, situated thereon. <br />
