PLEASE SUBSTITUTE FOR ORDINANCE .0. NO. 32-12 PLACED ON 1ST READING &~AEFERRED TO THE HOUSING COMMITTEE 6/4/12, 2ND READING 6/18/12. ORDINANCE NO. 32-12 BY: Andreson, Bullock, Juris, Madigan, Nowlin, Powers, Smith. AN ORDINANCE to take effect inunediately provided it receives the affirmative vote of at least five (5) members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, amending Section 741.071, Display for Sale of Household Goods and Furnishings fi•om Nonretail Occupancies, of the Codified Ordi- nances ofthe City of Lakewood to establish regulations for yard and garage sales. WHEREAS, Section 741.071 of the Lakewood Codified Ordinances offers some but little restriction of yard and garage sales and thus stands to be amended to create more clarity for residents desiring to host such sales; and WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits municipalities to exercise all powers of local self-government and to adopt and enforce within their limits such as local police, sanitary and other regulations as ate not in conflict with general laws; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in Article III, Sections 10 and 13 of the Se- cond Amended Charter of the City of Lakewood, and that it is necessary to provide for the usual daily operation of municipal departments iu that the yard and garage sale season is upon us; now, therefore BE IT ORDAINED BY THE CITY OF LAKEWOOD, OIIIO: Section 1. Section 741.071, Display for Sale of Household Goods and Furnish- ings from Nonretail Occupancies, of the Codified Ordinances of the City of Lakewood, currently reading as follows: 741.071 DISPLAY FOR SALE OF HOUSEHOLD GOODS AND FURNISHINGS FROM NONRETAIL OCCUPANCIES. (a) No person shall display for sale, any household goods, furnishings or personal effects, including clothing, in any area of nonretail oc- cupied premises upon which such goods are displayed other than from the rear yard as defined in Section I (03.02(ccc) of the Ton- ing Code and/orthe garage, if any, situated thereon.
