ORDINANCE NO. 37-12 BY: Anderson, Bullock, Juris, Madigan, Nowlin AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five members of Council, or otherwise to take effect and be in force after the earliest pe- riod allowed by law, establishing Section 111.14, Authority to Accept Income or Other Things of Value, in order to provide for proper municipal control over the City's receipt of donations, grants, goods and services. WHEREAS, the City is often a recipient of donated monies, services or things of value; and WI IEREAS, the code stands to be updated to provide for the handling of from de mininais gifts to those of greater value; and WHEREAS, pursuant to the Constitution of the State of Ohio, the Ohio Revised Code and the Second Amended Charter of the City of Lakewood, municipalities have the power to en- act laws that are for the health, safety, welfare, comfort and peace of the citizens of the munici- pality, and to provide for local self-govermnent, including identifying and placing restrictions on the receipt of income and other things of value; and WHEREAS, this Council by a vote of at least five of its members determines that this ordinance is an emergency measure; that it shall take effect immediately as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood; and that it is necessary in order to immediately provide for the peaceful and orderly execution of municipal operations; now, therefore BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: Section 1. Section 111.14 of the Codified Ordinances, titled Authority to Accept Income or Other Things of Value, shall be and hereby is enacted to read as follows: 111.14 AUTHORITY TO ACCEPT INCOME OR OTHER THINGS OP VALUE. All income or other things of value offered to the City shall be approved by Council prior to being accepted, except that the Director of Finance shall have authority to accept the following without separate approval of Council: (a) all income a• other things of valae received under the authority of the Con- stitution and statutes of the State, the charter, ordinances and resolutions of the City, and general law; (b) donations or awards of money, goods or services with a value of greater than $500.00 that require no expenditure of matching fiords by the City,
