PLACED ON 1ST READING & REFERRED TO THE <br />FINANCE COPfMITTEE 7/16/12. <br />ORDINANCE NO. 37-12 <br />BY: Anderson, Bullock, Juris, <br />Madigan, Nowlin <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force after the earliest pe- <br />riod allowed by law, establishing Section 111.14, Authority to Accept Income or Other Things of <br />Value, in order to provide for proper municipal control over the City's receipt of donations, <br />grants, goods and services. <br />WHEREAS, the City is often a recipient of donated monies, services or things of value; <br />and <br />WI IEREAS, the code stands to be updated to provide for the handling of from de mininais <br />gifts to those of greater value; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio, the Ohio Revised Code <br />and the Second Amended Charter of the City of Lakewood, municipalities have the power to en- <br />act laws that are for the health, safety, welfare, comfort and peace of the citizens of the munici- <br />pality, and to provide for local self-govermnent, including identifying and placing restrictions on <br />the receipt of income and other things of value; and <br />WHEREAS, this Council by a vote of at least five of its members determines that this <br />ordinance is an emergency measure; that it shall take effect immediately as set forth in Article <br />III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood; and that it is <br />necessary in order to immediately provide for the peaceful and orderly execution of municipal <br />operations; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Section 111.14 of the Codified Ordinances, titled Authority to Accept Income <br />or Other Things of Value, shall be and hereby is enacted to read as follows: <br />111.14 AUTHORITY TO ACCEPT INCOME OR OTHER THINGS OP <br />VALUE. <br />All income or other things of value offered to the City shall be approved by <br />Council prior to being accepted, except that the Director of Finance shall have <br />authority to accept the following without separate approval of Council: <br />(a) all income a• other things of valae received under the authority of the Con- <br />stitution and statutes of the State, the charter, ordinances and resolutions of <br />the City, and general law; <br />(b) donations or awards of money, goods or services with a value of greater <br />than $500.00 that require no expenditure of matching fiords by the City, <br />
