43-11 Amend Zoning Code - Conditional use for drive-thru facilities

Reference Sections 1129.17 and 1161.03(v). Section 3. That new Section 1129.17, Supplemental Regulations for Drive-Tluough Fa- cilities, of the Codified Ordinances of the City of Lakewood shall be enacted to read as follows: 1129.17 SUPPLEMENTAL REGULATIONS FOR DRIVE-THROUGH FACILITIES. A drive-through facility shall be conditionally permitted in Cl Office, C2 Retail, C3 General Busuress, and PD Planned Development only as an accessory use to permitted or conditionally permitted uses. No drive-through facility shall be permitted as an accessory use to a sexually oriented business. The sale or offer- ing for sale of any alcoholic beverage shall not be permitted within adrive- through facility. Section 4. That Section 1143.04, Use Categories, of the Codified Ordinances of the City of Lakewood, currently reading as follows: 1143.04 USE CATEGORIES. For the purposes of calculating parking and loading requirements, uses are de- fined as follows: (b) Food and Beverage Services: (3) Fast food;n~cluding delicatessen, drive-in, etc., which provides quickly or previously prepared food to a service counter; the patron carries the food out or to an indoor or outdoor seating area. (e) Office and Business Services: (2) Financial services offices; hrcludurg, but not limited to, collection ser- vices, commodity or security broker/dealer, currency exchange, em- ployment agencies, employment services, finaircial institutions includ- ing banks, savings and loans, credit unions, with or without drive-in fa- cilities, fmancial counseling, income tax preparation, insurance agen- cies and brokers/service offices, loan companies, labor unions, and real estate offices. shall be and is hereby amended to read as follows: 1143.04 USE CATEGORIES.
