Section 1. Chapter 1502 of the Lakewood Codified Ordinances, currently reading <br />as follows: <br />1502,01 INSPECTION OF UNDERGROUND TANKS BY FIRE <br />DIVISION; PERMITS; INVENTORY BY OPERATORS OF OIL- <br />BURNING EQUIPMENT. <br />(a) Ohio Administrative Code Permanent Rule 1301:7-9-IS enables the <br />State Fire Marshal to delegate to local fire departments the authority to <br />conduct inspections of underground storage tanks for compliance with <br />State regulations concerning installations, repairs, upgrades and remov- <br />als. The Lakewood Fire Division is authorized to perform such inspec- <br />tions and is empowered to obtain authority from the State Fire Marshal <br />to issue delegated underground storage tank permits which are required <br />to be obtained from the State Fire Marshal by owners and operators of <br />underground storage tanks. <br />(b) Ohio Administrative Code Rules Sections 1301:7-9-06, -07 and -08 <br />are hereby incorpw•ated herein by reference and all properly owners in <br />the City of Lakewood must be in compliance therewith. <br />(c) Operators ofoil-burning equipment shall make an inventory of un- <br />derground tanks at least once every seven days for the pw'pose of <br />checking whether or not there is any loss or accumulation of water. <br />1502.02 DISPOSAL AND ABANDONMENT OF TANKS. <br />(a) A permit shall be obtained from the Fire Chief to remove, abandon, <br />place temporarily out of service or otherwise dispose of any under- <br />ground storage tank containing flammable or combustible liquids. <br />(b) Tanks "temporarily out of service" shall have the fill line, gauge <br />opening and pump connection secured against tampering. Vent lines <br />shall remain open and be maintained in accordance with the require- <br />ments of the Ohio Administrative Code for vent tines. <br />(c) Any tank not used for a period of ninety days shall be properly <br />safeguarded or removed in a manner approved by [he Fire Chief or his <br />designee. <br />(d) Any tank which has been abandoned far a period of one year shall <br />be removed fiom the property in a mamrer approved by the Fire Chief <br />or his designee and the site restored in an approved manner. When the <br />Fire Chief or his designee determines that the removal of the tank is not <br />necessary, he may permit the tank to be abandoned in place in accor- <br />dance with API 1604 listed in Rule 1301:7-7-34 of the Ohio Adminis- <br />trative Code, and in accordance with the following procedures: <br />(1) All flammable or combustible liquid from the tank and all connect- <br />ing lines shalt be removed. <br />(2) The suction, inlet, gauge and vent lines shall be disconnected <br />
