(3) The tank shall be filled completely with an inert solid material The <br />remaining underground piping shall be capped. <br />(4) A record shall be kept of the tank size, location, date of abandon- <br />ment and method used for placing the abandoned tank in a safe condi- <br />tion. <br />1502.03 NEW OCCUPANCIES. <br />New occupancies, due to a change of ownership or change of lease, <br />shalt have a hydrostatic test performed and shall have adequate inven- <br />tory records before a permit is issued. A copy of the test results and in- <br />ventories shall be received by the Fire Chief and, if there are no leaking <br />conditions, a permit may be issued at that time. <br />1502.04 REPORTS AND RECORDS; TESTING FOR UNDER- <br />GROUND LEAKS. <br />Any leaking condition, shortage of flammable and combustible liquids, <br />or spills into public sewers, drains and waterways, shall be reported at <br />once to the Fire Chief or his designee. Procedures for locating and test- <br />ing for underground leaks shall be as outlined in N.F.P.A. Pamphlet <br />No. 329, "Underground Leakage of Flanunable and Combustible Liq- <br />uids." Storage tank inventory records for the thirty days prior to the <br />closing date shall be made available to the Fire Chief prior to the clos- <br />ing of a station. <br />]502.05 COSTS; CORRECTIONS. <br />Costs incurred by the City, which may entail Fire Division personnel or <br />their designated assistants, or supplies, equipment or work which may <br />be ordered by the Fire Chief, shall be the sole responsibility of the <br />owner of the tanks. Corrections shall be made as soon as possible to <br />protect life and property. <br />1502.06 PERMIT FEES. <br />The fee for all permits issued by the Fire Chief pursuant to this chapter <br />shall be as stated in cm•rent fees adopted by ordinance of the City <br />Council or as designated by the Fire Chief <br />1502.99 PENALTY. <br />Whoever violates or fails to comply with any of the provisions of this <br />chapter is guilty of a tnisdemeanor of the first degree and shall be fined <br />not more than one thousand dollars ($1,000) or imprisoned not more <br />than six months, m• both, for each offense. A separate offense shall be <br />deemed committed each day during m• on which a violation or non- <br />complianceoccurs or continues. <br />shall be and hereby is repealed. <br />Section 2.
