with designate one person as the City's member of afact-finding authority and <br />shall a<h~ise the unit representing City employees, or the employees' organiza- <br />tion, whichever the case may be, of the name of such member. Such unit m' or- <br />ganization shall forthwith designate one person as the employee member of the <br />fact-finding authority, and shall advise the Nlaym' and the President of Council <br />in writing of the name of such member. No person shall be eligible to serve on <br />the fact-finding authority if he is or has been an employee of the City m the enr <br />ployee organization, or if he has participated in negotiations on the issues under <br />consideration or has been involved in any way directly or indirectly in prepara- <br />tion of such issues. The hvo designated members shall meet within five days of <br />their designation and shall attempt to agree upmi an impartial third person as <br />chairman of the fact-finding authority. They shall jointly serve iu ~a~riting upon <br />the Mayor' and the President of Council the name of the chairman so selected. In <br />the event they are unable to agree upon an impartial chairman, they shall jointly <br />or separately request a panel of five names from the American Arbih'ation Asso- <br />ciation, who, upon inquiry, have indicated availability to meet as a member of <br />the fact-finding authority within ten days of selection. The representatives ofthe <br />City and employee organization invoh~ed will alternately strike names from the <br />Iist until one name remains. The individual whose name remains shall be select- <br />ed as the chairmmt of the fact-finding authority unless for any reason he gives <br />subsequent notice that he will be unable to meet within feu days. In that event, <br />the fourth name stricken shall be chosen. Fees charged by members of the fact- <br />linding authority and any other costs involved shall be divided equally behveen <br />the City and the employee oganizatiot. <br />(d) The chairman shall convene the fact-finding authority within ten days of his <br />appointment. ThereaRer, the representative of the City and the employee organi- <br />zation involved shall submit their respective positions to the fact-finding au- <br />Ihority for its review and recommendations. The fact-finding authority shall, <br />within fifteen days it' possible, issue in writing afact-finding report. 'this report <br />shall be served upon the respective chairman of the negotiating committee for <br />the City and the employee m'ganization invoh~ed, and the Mayor and the Presi- <br />dent of Council. As soon after receipt of such report as possible, the representa- <br />tives of the City and employee organizatimt shall meet again and seek to reach <br />agreement. If subsequent agreement is reached, it will be submitted to Council <br />for appropriate action. If agreement is not reached within fifteen days of the is- <br />suance of the report (unless the pmties mutually agree to ectend the fiiieen day <br />period), the fact-finding report shall be submitted by the President of Council, <br />together with the respective positions of the City and employee organization in- <br />volved, to Council tot' its decisiort. <br />157.05 NO S'I'RIICE <br />Nothing in this chapter shall cmtstihrte a grant of the right to strike to employees <br />of the City and such strikes arc prohibited. <br />157.06 RESCRVATION OP RIGHTS. <br />Ciq~ officials muI deparhnent supervisors retain the right in acem'dance with ap- <br />plicable laws and regulations: <br />(a) 'I'o direct the work of City employees; <br />
