include any organization (I) which discriminates with regard to the terms and <br />conditions of membership because of race, color', creed or national origin; and <br />(2) which, in the opinion of the Finance Committee, is so subject to corrupt in- <br />Rucnces or inthiences opposed to basic democratic principles that recognition <br />would be inconsistent with the objectives of this chapter. <br />(c) "Ciq~" means the City of Lakewood or any agency, instrumentality or de- <br />parhnent thereof and/m' elected or administrative officials who exercise gov- <br />ernmental powers under the ordinances of the City. <br />157.03 RIGHTS OF CITY GMPLOYEGS. <br />City employees shall have the right ofself-organization, to form and join associ- <br />ations for representation purposes, to join, form and affiliate with employee or- <br />ganizations of their own choosing, and shall have the right to be represented by <br />such representatives or employee organizations of their own choice in confer- <br />ences, meetings and negotiations with officers, agents, representatives and ear <br />ployeas of the Ciq~ on matters affecting their employment. <br />157.04 COLLECTIVE I3ARGAININC PROCF.DURC,. <br />(a) (I) By December I S of each year, City employees in an appropriate unit, or <br />by duly authorized representatives, shall submit a "list of requests" relating to <br />changes sought for the following year in wages and conditions of employment to <br />the chairman of the Finance Committee of Council. <br />(2) Employee organizations which have executed written collective bargaining <br />agreements with the City shall submit any proposed amendments to such agree- <br />ments not later than 120 days prior to the expiration date of the agreement to <br />which such amendments pertain to the chairman of the Finance Committee of <br />Council. <br />(b) (I) ~Nhenever a "list of requests" has been submitted to the Finance Com- <br />mittee as outlined in paragraph (a) (I) hereof, the Committee, through its chair- <br />man mdesignated representative, shall respond to such requests by January I S <br />of each year. The chairman shall then schedule the first bargaining session with- <br />in ten days thcreaRer. <br />(2) Whenever such amendments have been submitted to the Finance Committee <br />as outlined in paragraph (a) (2) hereof, the Committee, through its chairman or <br />designated representative, shall respond to such requests within thirty days after <br />receipt of such amendments. The chairman shall then schedule the tirst bargain- <br />ing session within ten days thereafter. <br />(e) In the evmu the representatives ofthe City and the unit representing the City <br />employees are unable to reach an agreement by February I5, one or both may <br />advise the Mayor and the President of Council, in tariting, of the failure to reach <br />an agreement and request fact- finding. In the event the representatives of the <br />City and the employee organizations which have executed written collective <br />bargaining agreements arc unable to reach an agreement within sixty days prior <br />to the espii<~tion date of the particular collective bargaining agreement to which <br />such amendments pertain, one or bosh may so advise the Mayor and the Presi- <br />dent of Council and request fact-finding.
