der for criminal forfeiture under this subsection is as- <br />signed or h•ansferred and division (B)(2) or (3) of Ohio <br />R.C. 4503.234 applies, in addition to or independent of <br />any other penalty established by law, the court may fine <br />the offender the value of the vehicle as determined by <br />publications of the national autanobile dealer's associa- <br />tion. The proceeds from any fine imposed under this <br />subsection shalt be distributed in accordance with divi- <br />sion (C)(2) of Ohio R.C. 4503.234. <br />(d) If a court orders the immobilization of a vehicle under subsection (c) of <br />this section, the court shall not release the vehicle from the immobilization <br />before the termination of the period of immobilization ordered unless the <br />court is presented with current proof of financial responsibility with re- <br />spect to that vehicle. <br />(e) If a court orders the criminal forfeiture of a vehicle under subsection (c) of <br />this section, upon receipt of the order from the court, neither the Registrar <br />of Motor Vehicles nor any deputy registrar shall accept any application for <br />the registration or transfer of registration of any motor vehicle owned or <br />leased by the person named in the order. The period of denial shall be five <br />years after the date the order is issued, unless, during that five-year period, <br />the court with jurisdiction of the offense that resulted in the order termi- <br />nates the forfeiture and notifies the Registrar of the termination. If the <br />court terminates the forfeiture and notifies the Registrar, the Registrar <br />shall take all necessary measures to permit the person to register a vehicle <br />owned or leased by the person or to transfer the regishation of the vehicle. <br />(fl This section does not apply to motor vehicle rental dealers or motor vehi- <br />cle leasing dealers, as defined in Ohio R.C. 4549.65. <br />(g) Evidence of a conviction of, plea of guilty to, or adjudication as a delin- <br />quent child for a violation of this section or a substantially similar munici- <br />~~al ordinance shall not be admissible as evidence in an}= civil action that <br />involves the offender or delinquent child who is the subject of the convic- <br />tion, plea, or adjudication and that arises from the wrongfiil entrustment of <br />a motor vehicle. <br />(h) Por purposes of this section, a vehicle is owned by a person if, at the time <br />of a violation of this section, the vehicle is registered in the person's name. <br />SECTION 4. It is fotmd and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Cowtcil, <br />and that all such deliberations of this Council and of airy of its committees that resulted in such <br />formal action were in meetings open to the public incompliance with all legal requirements. <br />SECTION 5. This ordinance is hereby declared to bean emergency measure necessary for <br />the inunediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the pre-amble <br />to this ordina~tce, and provided it receives the affirmative vote of at least five (5) members of <br />Council this ordinance shall take effect and be in force immediately upon its adoption by the <br />Council and approval by the Mayor, or otherwise shall take effect and be in force after the earli- <br />estperiod allowed by law. <br />
