and shall be punished as provided in subsections (c) to (Ir) of this sec- <br />tion. <br />(1) Except as provided in subsection (c)(2) of this section, whoever <br />violates subsection (a)(1), (2) or (3) of this sectimt is guilty of an <br />unclassified misdemeanor. When the offense is an unclassified <br />misdemeanor, the offender shall be sentenced pursuant to Ohio <br />R.C. 2929.21 to 2929.28, except that the offender shall not be <br />sentenced to a jail term; the offender shall not be sentenced to <br />a community residential sanction pursuant to Ohio R.C. <br />2929.26; notwithstanding division (A)(2)(a) of Ohio R.C. <br />2929.28, the offender may be fined up to one thousand dollars <br />($1,000); and, notwithstanding division (A)(3) of Olio R.C. <br />2929.27, the offender may Ue ordered pursuant to division (C) <br />of that sectimt to serve a term of community service of up to <br />five hundred homy. The faihtre of an offender to complete a <br />term of cmnmunity service imposed by the cow•t may be pun- <br />ished as indirect criminal contempt tinder division (A) of Ohio <br />R.C. 2705.02. <br />(2) A. If, within three years of a violation of subsection (a)(1), <br />(2) or (3) of this section, the offender previously has <br />pleaded guilty to or been convicted of two or more vio- <br />lations of division (A)(1), (2) or (3) of Ohio R.C. <br />4511.203 or a substantially equivalent municipal ordi- <br />nance, the offender is guilty of a misdemeanor of the <br />first degree. <br />B. Whoever violates subsection (a)(4) or (5) of this sectimt <br />is guilty of a misdemeanor of the first degree. <br />(3) For any violation of this section, in addition to the penalties <br />imposed under Section 303.99, the court may impose a class <br />seven suspension of the offender's driver's license, commercial <br />driver's license, temporary instruction permit, probationary li- <br />cense or nonresident operating privilege from the range speci- <br />fied in division (A)(7) of Ohio R.C. 4510.02, and, if the vehicle <br />involved in the offense is registered in the name of the of- <br />fender, the court may order one of the following: <br />A. lixcept as otherwise provided in subsection (c)(3)B, or <br />C. of this section, the court may order, for thirty days, <br />the immobilizatimt of the vehicle involved in the offense <br />and the impoundment of that vehicle's license plates. If <br />issued, the order shall be issued and enforced wider <br />Oltio R.C. 4503.233. <br />B. If the offender previously has been convicted of or <br />pleaded guilty to one violation of Ohio R.C. 4511.203 or <br />a substantially equivalent municipal ordinance, the <br />court may order, for sixty days, the immobilization of <br />the vehicle invoh~ed in the offense and the impound- <br />ment of that vehicle's license plates. If issued, the order <br />shall be issued and enforced under Ohio R.C. 4503.233. <br />C. If the offender previously has been convicted of or <br />pleaded guilty to two or more violations of Ohio I2.C. <br />4511.203 or a substantially equivalent municipal ordi- <br />nance, the court may order the criminal forfeiture to the <br />state of the vehicle involved in the offense.
