PLACED ON 1ST READING & REFERRED TO THE <br />FINANCE COMMITTEE 11/19/12. <br />SECOND READING 12/3/12. <br />ORDINANCE NO. 73-12 BY: Anderson, Bullock, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five (5) members of Council, or otherwise to take effect and be in force after the earliest <br />period allowed by law, amending section 902.04, Rates and Charges, of the Codified Ordinances <br />of the City of Lakewood for the purpose of adjusting sewer rates charged against each lot, parcel <br />of land or premises which may have an active sewer connection with the Municipal wastewater <br />disposal system or which may otherwise discharge wastewater either directly or indirectly into <br />such system or any part thereof. <br />WHEREAS, the current sewer rate is insufficient to allow the Wastewater Treatment <br />Fund and Wastewater Collections System Fund to continue to be self-supporting; and <br />WHEREAS, in order to offset the continuing general increases in capital costs of the <br />wastewater collections and treatment facilities it is necessary for the City to increase the rates <br />charged to the users of the wastewater disposal system as well as provide for the anticipated <br />annual capital needs for the wastewater collection and treatment system; and <br />WHEREAS, Chapter 902 of the Codified Ordinances authorizes the City to set sewer <br />rates to distribute the costs of operation and maintenance of the wastewater disposal system and <br />the costs to maintain compliance with applicable standards and regulations of the U.S. E.P.A. <br />proportionately upon all users of said system; and <br />WHEREAS, this Council by a vote of at least five (5) of its members determines that this <br />ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date <br />possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the <br />City of Lakewood, and that it is necessary for the immediate preservation of the public peace, <br />propet•ty, health and safety, and to provide for the usual daily operation of municipal departments <br />in that these rates and charges must be in place for the 2013 fiscal year. Now therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO <br />Section I. That section 902.04, Rates and Charges, of the Codified Ordinances of the <br />City of Lakewood cun•ently reads as follows: <br />902.04 RATES AND CIiA12GES. <br />(a) The Director of Finance is hereby authorized to annually establish sewer rates <br />charged by the Division of Utility Billh~g. <br />(1) Such charges and rates shall be made against each lot parcel of land or <br />premises which may have an active sewer connection with the <br />Mwricipal wastewater disposal system or which may otherwise <br />discharge wastewater either directly or indirectly into such system or <br />any part thereof. <br />
