PLACED ON 2ND READING 9/15/13. <br />ORDINANCE NO. 22 -13 BY: Anderson, Bullock, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />AN ORDINANCE amending Section 113.04, Fair Employment Wage Board, of the Cod- <br />ified Ordinances of the City of Lakewood to disband the Board and assign the duties of the <br />Board to the Civil Service Commission. <br />WHEREAS, employees of the City are currently ensuring compliance with the Fair Em- <br />ployment Wage Ordinance without assistance from the Fair Employment Wage Board (FEWB) <br />which has remained unstaffed and inactive since 2009; and <br />WHEREAS, both the Civil Service Commission and the FEWB are assigned duties and <br />have expertise in areas of fair wages; and <br />WHEREAS, it is in the interest of efficiency to eliminate the FEWB and assign its duties <br />to the Civil Service Commission; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits munic- <br />ipalities to exercise all powers of local self - government and to adopt and enforce within their <br />limits such as local police, sanitary and other regulations as are not in conflict with general laws; <br />now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Section 113.04, Fair Employment Wage Board, of the Codified Ordinances of <br />the City of Lakewood, currently reading as follows: <br />113.04 FAIR EMPLOYMENT WAGE BOARD. <br />(a) The Fair Employment Wage Board (FEWB) shall review the effectiveness of <br />the living wage ordinance to ensure that the community is informed on <br />whether those companies that are being awarded service contracts by the <br />City are adhering to the ordinance. The FEWB shall make recommendations <br />to the Administration and Lakewood City Council, when appropriate, regard- <br />ing issues pertaining to the living wage policy. <br />(b) The FEWB shall be composed of seven (7) members, six of whom shall be <br />electors of the City, the seventh member shall be a representative of the <br />Mayor's administration. Three members of the Board shall be appointees of <br />the Mayor, and three members shall be appointees of Council. The Mayor <br />and Council shall appoint one appointee from the business community, a la- <br />bor organization, and a community group. The appointing authority of a <br />Board member may remove that member for cause. No person shall be ap- <br />pointed to the FEWB who has any interest in a contract with the City of <br />Lakewood. <br />(c) The Mayor shall initially appoint three (3) members of the FEWB for one- <br />year terns, two (2) members for two (2) year terms, and two (2) members for <br />a tluee (3) year term.
