Please substitute <br />for the original. <br />ORDINANCE NO. 27 -13 BY: Anderson, Bullock, Juris, <br />Madigan, Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force after the earliest pe- <br />riod allowed by law, authorizing and directing the Director of Planning and Development, on <br />behalf of the City of Lakewood Land Reutilization Program, to transfer the real property de- <br />scribed herein, formerly bearing permanent parcel number 311 -14 -102, to Clifton Pointe II LLC, <br />pursuant to Section 5722.07 of the Ohio Revised Code and Section 155.07 of the Codified Ordi- <br />nances, for $1 and other good and valuable consideration. <br />WHEREAS, following a foreclosure and sheriff's deed recorded in 2010, the City of <br />Lakewood Land Reutilization Program became the titled owner of real property formerly bearing <br />permanent parcel number 311 -14 -102, located on the north side of Sloane Avenue; and <br />WHEREAS, that parcel of land was and remains vacant and nonproductive; and <br />WHEREAS, the City of Lakewood Land Reutilization Program was formed by Ordi- <br />nance 55 -07 on July 5, 2007, under the provisions of Chapter 5722 of the Ohio Revised Code, to <br />bring nonproductive land within the City back into productivity; and <br />WHEREAS, Section 5722.07 of the Ohio Revised Code enables cities holding property <br />in the name of a land reutilization program to sell that property, without competitive bidding, at <br />such times, to such persons, and upon such terms and conditions, and subject to such restrictions <br />and covenants as it deems necessary or appropriate to assure the land's effective reutilization; <br />and <br />WHEREAS, Section 5722.07 of the Revised Code requires that such property be sold at <br />not less than its fair market value; and <br />WHEREAS, the real property formerly bearing permanent parcel number 311 -14 -102, <br />located on the north side of Sloane Avenue, has no marketable value because it is 7.5 feet by <br />18.25 feet in area, is landlocked without means of egress to a public right -of -way, and was the <br />subject of court orders in 1990 and 1991 forever tying it to its adjoining parcel, 311 -14 -017; and <br />WHEREAS, the adjoining parcel, 311 -14 -017, is owned by Clifton Pointe II LLC, which <br />intends to return the real property formerly bearing parcel number 311 -14 -102 to productive sta- <br />tus; and <br />WHEREAS, this Council has determined it is in the best interest of the City to sell said <br />real property and that such sale shall further the interest of the City and its residents; and <br />
