WHERAS, this Council by a vote of at least five (5) of its members determines that this <br />ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date <br />possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City <br />of Lakewood, and that it is necessary for the immediate preservation of the public property, <br />health and safety, and to provide for the usual daily operation of municipal department in that <br />this property is currently vacant and immediate action is required; now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Director of Planning and Development ( "Director ") is hereby authorized <br />and directed, on behalf of the City of Lakewood Land Reutilization Program, to transfer the real <br />property described herein, formerly bearing permanent parcel number 311 -14 -102, to Clifton <br />Pointe II LLC, pursuant to Section 5722.07 of the Ohio Revised Code and Section 155.07 of the <br />Codified Ordinances, for $1 and other good and valuable consideration. <br />Section 2. The parcel of land that is the subject of this ordinance is further described as <br />follows: <br />Situated in the City of Lakewood, County of Cuyahoga and State of Ohio: <br />Beginning at the northwesterly corner of plaintiffs property known as being Sublot No. <br />27 in Mathews and Gilbert's High Bridge Park subdivision No. 4 of part of Original <br />Rockport Township Section No. 23 as by the recorded plot in Volume 30 of Maps, Page <br />10 of Cuyahoga County Records, and then moving 7.5 feet eastward along the northerly <br />border and then 18.25 feet southward from the northerly border and then 7.5 feet west- <br />ward to the wester property and then northward 18.25 feet to the northwesterly corner of <br />plaintiff property as herein described, be the same more or less, but subject to all legal <br />highways. <br />Section 3. The fair market value of the parcel of land that is the subject of this ordinance <br />is affixed at $1. <br />Section 4. The Director is hereby authorized and directed to enter into any instruments of <br />conveyance or other documents necessary to carry forth the provisions of this ordinance. <br />Section 5. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />Section 6. That this ordinance is hereby declared to be an emergency measure necessary <br />for the immediate preservation of the public peace, property, health, safety and welfare in the <br />City and for the usual daily operation of the City for the reasons set forth and defined in the pre- <br />amble to this ordinance, and provided it receives the affirmative vote of at least five members of <br />Council, this ordinance shall take effect and be in force immediately upon its adoption by the <br />Council and approval by the Mayor, or otherwise it shall take effect and be in force after the ear- <br />liest period allowed by law. <br />
