B. Maintenance requirements of each BMP; <br />C. Identification of the entity responsible for long -tern maintenance; <br />D. Posting of a two -year maintenance bond in the amount of 25 per- <br />cent of the storm water infrastructure installed value as determined <br />by the city engineer; and <br />E. Signature, seal and date approved by a professional engineer. <br />(c) Perpetual Agreement. An approved inspection and maintenance agreement <br />shall be filed with the City division of housing and building. The agreement <br />must be signed by the contractor, City and the private owner or homeown- <br />ers association who will take long -term responsibility for the pernanent <br />BMPs. <br />1339.99 PENALTIES. <br />(a) No person shall violate, or cause, or knowingly permit to be violated, any of <br />the provisions of this chapter, or fail to comply with any such provisions or <br />with any lawful requirements of any public authority made pursuant to this <br />chapter, or knowingly use or cause or permit the use of any lands in viola- <br />tion of this chapter or in violation of any permit granted under this chapter. <br />(b) Whoever violates or fails to comply with any provision of this regulation is <br />guilty of a misdemeanor of the first degree and shall be fined no more than <br />$1,000.00 or imprisoned for no more than 180 days, or both, for each of- <br />fense. <br />(c) A separate offense shall be deemed committed each day during or on which <br />a violation or noncompliance occurs or continues. <br />(d) Upon notice from the city engineer, or designated representative, that a pro- <br />ject site does not meet the requirements of this chapter, such work shall <br />immediately stop. Such notice shall be in writing and shall be either hand - <br />delivered or sent by certified mail, return receipt requested, to the owner or <br />person responsible for the development area, or person performing the <br />work, and shall state the conditions wider which such work may be re- <br />sunned; provided, however, in instances where immediate action is deemed <br />necessary for public safety or the public interest, the city engineer may re- <br />quire that work be stopped upon verbal order pending issuance of the writ- <br />ten order. <br />(e) The imposition of any other penalties provided herein shall not preclude the <br />City, by or through its law director or any of his or her assistants, from insti- <br />tuting an appropriate action or proceeding in a court of proper jurisdiction <br />to prevent an unlawful development or to restrain, correct or abate a viola- <br />tion, or to require compliance with the provisions of this regulation or other <br />applicable laws, or ordinances, rules or regulations or the orders of the city <br />engineer. <br />1000, <br />
