Please substitute for the original. <br />ORDINANCE NO. 13 -15 BY: Anderson, Juris, Madigan, <br />Mars, Nowlin, O'Leary,. <br />AN ORDINANCE amending Chapter 143, City Records Commission, of the <br />Codified Ordinances of the City of Lakewood, in order to update the code regulating the <br />composition and duties of this commission. <br />WHEREAS, the City Records Commission was created to promote open records <br />and fulfill the City's obligations under state public records law; and <br />WHEREAS, Chapter 143 of the Code stands to be updated to bring the composi- <br />tion and duties of the City Records Commission in line with state law, which has been <br />updated throughout the years and most recently in 2011; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Re- <br />vised Code, municipalities have the power of local self - government; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Re- <br />vised Code, municipalities have the power to enact laws that are for the health, safety, <br />welfare, comfort and peace of the citizens of the municipality; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Chapter 143, City Records Commission, of the Lakewood Codified <br />Ordinances, currently reading as follows: <br />CHAPTER 143 <br />CITY RECORDS COMP <br />143.01 ESTABLISHMENT AND <br />There is hereby established a City Records Commission to be com- <br />posed of the Mayor, one member of Council appointed by the Presi- <br />dent, the senior Judge of the Municipal Court, the Director of Law and <br />the Finance Director. <br />143.02 FUNCTIONS OF COMMISSION. <br />The functions of the City Records Commission shall be to review all <br />applications for records disposal or transfer and all schedules of record <br />retention and destruction and all records disposal lists submitted by any <br />office, court, commission, board, department or agency of the City. <br />Such records may be disposed of by order of the Commission pursuant <br />to the procedure hereinafter outlined. <br />
