a majority vote of the electors of the City of Lakewood at a general electiol. Said general <br />election shall be held not less than ninety (90) days and not more than one hundred fifty <br />(150) clays after the ordinance is passed by Council. If there is no such general election <br />within that time frame, then such ordinance shall be presented to the voters for their <br />approval at a special election to be held within such time frame. <br />Sach ordinances shall include, without limitation, any and all actions for the sale, lease, <br />lease extension or renewal, sublease, managennent, closure, abandomnent, demolition, or <br />definitive agreement, contract, or agreement, that would cause Lakewood Hospital, in <br />whole or io part, to no longer be a full time and full service hospital and medical facility <br />providing, without limitation, iupatient diagnostic, medical, surgical, and psychiatric <br />care for a continuous period longer than twenty -four hours. <br />This charter amendment provision shall be liberally construed to protect, preserve, and <br />safeguard Lakewood Hospital as a full time and full service hospital and medical facility <br />providing, without limitation, inpatient diagnostic, medical, surgical, and psychiatric <br />care for a continuous period longer than twenty -four hours, through the elective process <br />by nneans of a vote of the electors of the City of Lakewood. <br />The provisions of this Section to the extent that it conflicts with m• is inconsistent with <br />any other provisions of the City Charter, shall supersede and control over any and all <br />such other provisions of the City Charter. <br />Section 2. The Board of Elections of Cuyahoga County is hereby authorized to submit <br />the following proposed ballot question to the registered voters of the City at the general election <br />on November 3, 2015: <br />Shall (Joe Second Amended Charter of the City of Lakewood be amended to create an <br />automatic referendum, requiring an affirmative vote by a majority of the registered vot- <br />ers of the city for passage, on any ordinance adopted by council that wadd cause Lake- <br />wood Hospital to no longer be a full -time and full-service hospital and medical facility <br />providing, without limitation, inpatient diagnostic, medical, surgical, and psychiatric <br />care for a continuous period longer thou tweaty -four hours? <br />Section 3. The Clerk of this Council is instructed immediately to file a certified copy of <br />this ordinance and the proposed form of the ballot question with the County Board of Elections <br />not less than 60 days and not more than 120 days prior to November 3, 2015. <br />Section 4. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />Section 5. This ordinance is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the pream- <br />ble, and provided it receives the affirmative vote of at least five members of Council, this ordi- <br />nance shall take effect and be in force immediately upon its adoption by the Council and ap- <br />proval by the Mayor, or otherwise it shall take effect and be in force after the earliest period <br />allowed by law. <br />
