Please substitute for Ordinance No. 2 -16. <br />Placed on 1" Reading and referred to the <br />Committee of the Whole & Planning Commission <br />on 1/19/16, 2 "d Reading 2/1/16, Referred to <br />Committee of the Whole 3/7/16, Deferred <br />3/21/16. <br />ORDINANCE NO. 2-16 BY: Anderson, Bullock, Litten, <br />Marx, O'Leary, O'Malley. <br />AN ORDINANCE to amend various sections within Chapter 1329, Signs, of the Codified <br />Ordinances of the City of Lakewood and other sign - related sections in order to update the code. <br />WHEREAS, in July 2015 the U.S. Supreme Court issued a decision in Reed v. Gilbert; <br />and <br />WHEREAS, the Court for the first time has ruled that a sign code which categorically <br />regulates signage and that requires the content of the sign to be read to determine the category of <br />sign as content -based regulation and, therefore, unconstitutional under the First Amendment; and <br />WHEREAS, Lakewood's current sign code may fall within this prohibited regulation on <br />speech as interpreted by the U.S. Supreme Court in the Reed case; and <br />WHEREAS, updates are required to insure that Lakewood maintains reasonable <br />regulations of signage within the community without violating First Amendment rights; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self - government and to adopt and enforce within <br />their limits such as local police, sanitary and other regulations as are not in conflict with general <br />laws; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Chapter 1329, Signs, of the Codified Ordinances of the City of Lakewood, <br />currently reading as follows: <br />CHAPTER 1329 <br />Signs <br />1329.01 INTENT. <br />(a) Sign regulations, including provisions to control the type, design, size, <br />location, illumination and maintenance thereof, are established in order to <br />achieve, among others, the following purposes: <br />(1) To promote attractive and maintain high value residential districts by <br />permitting only nameplates, bulletin boards and signs related to the develop, <br />rental or sale of properties in such districts; <br />
