First Reading & Referred to the Rules & <br />Ordinances Committee 7/18/16. <br />Second Reading 9/6/16. <br />ORDINANCENO. 34 -16 BY: Anderson, Bullock, Litton, Marx, <br />Nowlin, O'Leary, O'Malley. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five members of Council, or otherwise to take effect and be in force after <br />the earliest period allowed by law, to establish minimum coverage limits and fees re- <br />quired under various sections of the Lakewood Codified Ordinances related to insurance. <br />WHEREAS, Ordinance No. 59 -14, which was adopted January 20, 2015, and <br />which established certain fees and minimum limits of insurance required within various <br />sections of the Codified Ordinances, stands to be amended; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio, the Ohio Revised <br />Code and the Second Amended Charter of the City of Lakewood, municipalities have the <br />power to enact laws that are for the health, safety, welfare, comfort and peace of the citi- <br />zens of the municipality, and to provide for local self - government, including establishing <br />insurance limits and insurance - related fees; and <br />WHEREAS, this Council by a vote of at least five of its members determines that <br />this ordinance is an emergency measure, and that this ordinance shall take effect at the <br />earliest date possible as set forth in Article III, Sections 10 and 13 of the Second Amend- <br />ed Charter of the City of Lakewood, and that it is necessary for the immediate preserva- <br />tion of the public property, health and safety, and to provide for the usual daily operation <br />of municipal departments in that these changes need to be incorporated in order to permit <br />contractors the ability to register quickly in the City; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The minimum limit of insurance required under Section 506.04(a)(3) of <br />the Codified Ordinances shall be $250,000.00. <br />Section 2. The minimum limit of insurance required under Section 901.18(c)(2) of <br />the Codified Ordinances shall be $1 million. <br />Section 3. The minimum limit of insurance required under Section 1160.14 of the <br />Codified Ordinances shall be $1 million. <br />Section 4. The minimum limit of insurance required under Section 1321.02(a)(2) <br />of the Codified Ordinances shall be $1 million for general liability and $100,000.00 per <br />occurrence /$300,000.00 aggregate for automobile liability. Proof of workers' compensa- <br />tion coverage shall also be provided. <br />
