READ & REFERRED TO RULES & ORDINANCES <br />COMMITTEE 5/1/17. SECOND READING <br />5/15/17. <br />ORDINANCENO. 24 -17 BY: Bullock, Litten, Marx, Nowlin, <br />O'Leary, O'Malley. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five members of Council, or otherwise to take effect at the earliest period <br />allowed by law, amending various section of Chapter 505, Animals and Fowl, of the <br />Codified Ordinances of the City of Lakewood to update and provide penalties for viola- <br />tions of those provisions. <br />WHEREAS, currently Chapter 505 requires property maintenance of animal yard <br />structures and for owners of cats and dogs to have those animals vaccinated with a rabies <br />vaccine, but the code does not provide penalty provisions for those sections; and <br />WHEREAS, the chapter stands to be updated to eliminate mention of codified <br />regulations not found anywhere in the code; and <br />WHEREAS, this Council by a vote of at least five of its members determines that <br />this ordinance is an emergency measure and that it shall take effect immediately, as set <br />forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of <br />Lakewood, and that it is necessary for the immediate preservation of the public property, <br />health, and safety and to provide for the usual daily operation of municipal departments, <br />in that penalties should be provided for these sections immediately to allow their imme- <br />diate enforcement if necessary; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Section 505.10, Proper Maintenance of Animal Yard Structures and <br />Pens Required, of the Codified Ordinances, currently reading as follows: <br />505.10 PROPER MAINTENANCE OF ANIMAL YARD STRUC- <br />TURES AND PENS REQUIRED. <br />(a) No person shall keep or maintain any animal or fowl in any <br />yard, structure or area that is not clean, dry and sanitary; free from de- <br />bris and offensive odors that annoy any neighbor; and devoid of rodents <br />and vermin. <br />(b) All animal pens and yards shall be so located that adequate <br />drainage is obtained, normal drying occurs, and standing water is not <br />present. <br />(c) All premises other than private residences on which animals are <br />kept shall be subject to inspection by the Health Officer and /or the An- <br />imal Control Officer. If the Health Officer or the Animal Control Of- <br />ficer determines from such inspection that the premises are not be- <br />
