Second Read'll /20/17. <br />ORDINANCE NO.X1ix 97 -17 BY: Anderson, Bullock, George, Litten <br />O'Leary, O'Malley, Rader <br />AN ORDINANCE to take effect iumrediately provided it receives the affirmative <br />vote of at least five members of Council, or otherwise to take effect at the earliest period <br />allowed by law, aniending various sections within Part Three, Traffic Code, of the Codi- <br />fied Ordinances of the City of Lakewood, to reflect recent changes in the state traffic <br />code. <br />WHEREAS, the following changes have recently been made in the State of Ohio <br />traffic code; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self-government and to adopt and enforce <br />within their limits such as local police, sanitary and other regulations as are not in conflict <br />with general laws; and <br />WHEREAS, this Council by a vote of at least five of its members determines that <br />this ordinance is an emergency measure and that it shall take effect immediately, as set <br />forth in Article II1, Sections 10 and 13 of the Second Amended Charter of the City of <br />Lakewood, and that it is necessary for the immediate - preservation of the public property, <br />health, and safety and to provide for the usual daily operation of municipal departments, <br />in that it is in the City wishes to close any window of time where the local code and State <br />code are not in harmony; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />SECTION 1. Section 301.161 Highway Traffic Signal, of the Lakewood Codified <br />Ordinances, currently reading as follows: <br />301.161 HIGHWAY TRAFFIC SIGNAL. <br />"Highway traffic signal" means a power - operated traffic control device <br />by which traffic is warned or directed to take some specific action, <br />"Highway traffic signal" does not include a power - operated sign, stead- <br />ily illuminated pavement markers, warning light, or steady burning <br />electric lamp. (ORC 4511.01(NR&4)) <br />shall be and hereby is repealed, and new Section 301.161, Maintenance Vehicle, of the <br />Lakewood Codified Ordinances is enacted to read as follows: <br />301.161 HIGHWAY MAINTENANCE VEHICLE. <br />
