Passed 7- 19 -10.) <br />shall be and hereby is repealed, and new Section 355.04 Operation of Meters, of the <br />Lakewood Codified Ordinances is enacted to read as follows: <br />355.09 OPERATION OF METERS. <br />(a) Except in a period of emergency determined by an officer of the <br />Divisions of Fire or Police, or in compliance with the directions of a <br />police officer or traffic control sign or signal, when any vehicle is <br />parked in any parking space alongside or to which a parking meter <br />is located assured, the operator of such vehicle shall, upon entering the <br />parking meter space, immediately deposit make or cause to be made <br />depesitecl in the meter such proper Pain o f the United States payment as <br />is required for such parking meter and as is designated by proper direc- <br />tions on the meter, and when required by the directions on the meter, <br />the operator of such vehicle, after the deposit makin of the proper eein <br />oreeins payment, shall also set in operation the tinting mechanism on <br />such meter in accordance with directions properly appearing thereon, <br />and failure to deposit make such proper coin - payment and to set the <br />timing mechanism in operation when so required, shall constitute a Ao- <br />lation of this section. Upon the deposit makin of such coin rp ooer <br />ap went (and the setting of the timing mechanism in operation when so <br />required) the parking space may be lawfully occupied by such vehicle <br />during the period of time which has been prescribed for the part of the <br />street in which the parking space is located. Any person placing a vehi- <br />cle in a parking meter space adjaeont assirned to a meter which indi- <br />cates that unused time has been left in the meter by the previous occu- <br />pant of the space shall not be required to deposit make a rein More <br />a went so long as his occupancy of such space does not exceed the <br />indicated unused parking time. if such vehicle remains parked in any <br />such parking space beyond the parking time limit set for such parking <br />space, and if the meter indicates such illegal parking, then such vehicle <br />shall be considered as parking overtime and beyond the period of legal <br />parking time, and such parking shall be deemed a violation of this sec- <br />tion. <br />b As used in this section "proper payment' means payment by U S <br />currency, a credit card transaction a cellular phone application, any <br />combination of them or any other method as designated by directions <br />on the meter. <br />SECTION 38. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open meeting <br />of this Council and that all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the public in compliance <br />with all legal requirements. <br />SECTION 39. This ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health, safety and <br />welfare in the City and for the usual daily operation of the City for the reasons set forth <br />and defined in its preamble, and provided it receives the affirmative vote of at least five <br />
