ORDINANCE NO. 38-17 <br />Read & Referred to Rules & <br />Ordinances 11/20/17; Second <br />reading 12/4/17; Recommended <br />for adoption by Rules & Ordi- <br />nances 6/4/18 <br />Anderson, Bullock, George, Litten <br />BY: O'Leary, O'Malley, Rader <br />AN ORDINANCE to take effect at the earliest period allowed by law enacting Chapter <br />123, Departments and Directors Established, of the Codified Ordinances of the City of Lake- <br />wood in order to codify the administrative departments and their directors' responsibilities within <br />the City. <br />WHEREAS, on November 7, 2017, the citizens of Lakewood adopted the proposed Third <br />Amended Charter of the City of Lakewood; and <br />WHEREAS, the Third Amended Charter, at Article Four, Departments and Officers, pro- <br />vides for the establishment of the departments of law and finance and additional city depart- <br />ments, offices or agencies to provide and administer city services, including but not limited to <br />public safety, planning and development, human services and public works; and provides for the <br />head of each department to be a director; and <br />WHEREAS, this Council has determined that departments and directors shall be estab- <br />lished pursuant to these provisions as a matter of local self - government; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power of local self - government; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power to enact laws that are for the health, safety, welfare, comfort <br />and peace of the citizens of the municipality; and <br />WHEREAS, as set forth in either Article III, Sections 10 and 13 of the Second Amended <br />Charter of the City of Lakewood or Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, whichever is applicable at the time, this Council by a vote of at least five or two <br />thirds of its members, as applicable, determines that this ordinance is an emergency measure and <br />that it shall take effect immediately, and that it is necessary for the immediate preservation of the <br />public property, health, and safety and to provide for the usual daily operation of municipal de- <br />partments, in that the new charter becomes effective immediately upon the official certification <br />of the November 7, 2017 election in the city; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. New Chapter 123, Departments and Directors Established, shall be enacted to <br />read as follows: <br />
