Referred to Rules & Ordinances <br />11/20/17; Second reading 12/4/17; <br />Recommended for adoption by Rules <br />& Ordinances 6/4/18 <br />Anderson, Bullock, George, Litten <br />ORDINANCE NO. 39 -17 BY: O'Leary, O'Malley, Rader <br />AN ORDINANCE to take effect at the earliest period allowed by law amending various <br />sections within the Codified Ordinances of the City of Lakewood in order to update the code to <br />reflect the adoption of the Third Amended Charter. <br />WHEREAS, on November 7, 2017, the citizens of Lakewood adopted the proposed Third <br />Amended Charter of the City of Lakewood; and <br />WHEREAS, the Codified Ordinances make several references to the Second Amended <br />Charter of the City of Lakewood, and thus stand to be updated; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power of local self - government; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power to enact laws that are for the health, safety, welfare, comfort <br />and peace of the citizens of the municipality; and <br />WHEREAS, as set forth in either Article III, Sections 10 and 13 of the Second Amended <br />Charter of the City of Lakewood or Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, whichever is applicable at the time, this Council by a vote of at least five or two <br />thirds of its members, as applicable, determines that this ordinance is an emergency measure and <br />that it shall take effect immediately, and that it is necessary for the immediate preservation of the <br />public property, health, and safety and to provide for the usual daily operation of municipal de- <br />partments, in that the new charter becomes effective immediately upon the official certification <br />of the November 7, 2017 election in the city; now, therefore <br />BE IT ORDAINED BY THE CI"IY OF LAKEWOOD, OHIO: <br />Section 1. Section 101.09, Distribution and Charges, currently reading as follows: <br />101.09 DISTRIBUTION AND CHARGES. <br />(a) The Clerk of Council shall deliver one complete code in binder, including <br />the Charter to the Mayor, one to the Judge and Clerk of the Municipal <br />Court, one to each member of Council, one to the head of each department <br />or division of the City, one to the Lakewood Public Library and Madison <br />branch, one to the Lakewood Board of Education, one to the Juvenile Court <br />of Cuyahoga County, and to other Public Entities as deemed appropriate by <br />the Director of Law, and a complete code or such component parts of such <br />code to the employees in each department or division of the City as may be <br />
