Referred to Rules & Ordinances 11/20/17; Second reading 12/4/17; Recommended for adoption by Rules & Ordinances 6/4/18 Anderson, Bullock, George, Litten ORDINANCE NO. 39 -17 BY: O'Leary, O'Malley, Rader AN ORDINANCE to take effect at the earliest period allowed by law amending various sections within the Codified Ordinances of the City of Lakewood in order to update the code to reflect the adoption of the Third Amended Charter. WHEREAS, on November 7, 2017, the citizens of Lakewood adopted the proposed Third Amended Charter of the City of Lakewood; and WHEREAS, the Codified Ordinances make several references to the Second Amended Charter of the City of Lakewood, and thus stand to be updated; and WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised Code, municipalities have the power of local self - government; and WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised Code, municipalities have the power to enact laws that are for the health, safety, welfare, comfort and peace of the citizens of the municipality; and WHEREAS, as set forth in either Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood or Section 2.12 of the Third Amended Charter of the City of Lakewood, whichever is applicable at the time, this Council by a vote of at least five or two thirds of its members, as applicable, determines that this ordinance is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal de- partments, in that the new charter becomes effective immediately upon the official certification of the November 7, 2017 election in the city; now, therefore BE IT ORDAINED BY THE CI"IY OF LAKEWOOD, OHIO: Section 1. Section 101.09, Distribution and Charges, currently reading as follows: 101.09 DISTRIBUTION AND CHARGES. (a) The Clerk of Council shall deliver one complete code in binder, including the Charter to the Mayor, one to the Judge and Clerk of the Municipal Court, one to each member of Council, one to the head of each department or division of the City, one to the Lakewood Public Library and Madison branch, one to the Lakewood Board of Education, one to the Juvenile Court of Cuyahoga County, and to other Public Entities as deemed appropriate by the Director of Law, and a complete code or such component parts of such code to the employees in each department or division of the City as may be
