39-17 Amend COde to Reflect Adoption of 3rd Amended Charter

(a) Pursuant to Article I1I, Section 12 of the Second Amended City Charter , and notwithstanding any contrary definition or provision of the Ohio Re- vised Code, the Lakewood Sun -Post and the Cleveland Plain Dealer are each hereby determined to be a newspaper of general circulation within the City of Lakewood, and the Cleveland Plain Dealer is hereby determined to also be a newspaper of general circulation with Cuyahoga County. (b) For the purposes of this chapter, a legal notice shall provide as much detail as possible while making such notices as brief as reasonably may be ac- complished, reference in any such legal notice to the time, place, and gen- eral subject or purpose shall be sufficient, so long as more specific detail is made readily available both by referring to the specific location on the City's web pages for that detail and by listing a specific telephone number at which such detail can be described. (c) For the purposes of this chapter, the words "posting copies thereof' means the procedure as set forth in Section 107.01. shall be repealed, and new Section 107.02, Legal Notice in Newspaper or By Posting, shall be enacted to read as follows: 107.02 LEGAL NOTICE IN NEWSPAPER OR BY POSTING. Section 107.04, Notice of Special Assessment, currently reading as follows: 107.04 NOTICE OF SPECIAL ASSESSMENT. (a) Notice of the passage of a resolution of necessity and the filing of the esti- mated assessment required by Article XVI, Section 4 of the Second Amended City Charter shall be given to property owners or persons in whose names the property may be assessed for taxation upon the tax dupli- cate in the manner provided for service of summons in civil actions. For all nonresident property owners who cannot be found, the notice shall be pub- lished at least once in a newspaper of general circulation within the City.
