the amount necessary to pay for the City's proportionate <br />share of all poor relief costs, or that ~e proceeds of <br />any tax or funds made available by the State for poor <br />relief purposes apportioned to the County exceeds the <br />amount necessary to pay the City's proportionate share <br />of all poor relief costs, the County agrees that it will <br />hold such surplus as an unexpired balance, and will not <br />transfer it to any other use without the consent of the <br />City. In the event that the responsibility of the City <br />or of the County shall by law be increased beyond that <br />at the ti~e of entering into this Agreement, this <br />Agreement shall be subject to such modification as will <br />give due consideration to such change of responsibility. <br /> <br />5. This Agreement shall be in force and effect for a <br />period of one (1) year from and after F~ruary 1 , 1963, <br />and shall continue in full force and effect thereafter, <br />unless and until, terminated by either 'party upon written <br />notice to the other party not less than six (6)months <br />prior to the end of any calendar year; and upon such <br />cancellation, the County agrees to assign, transfer and <br />deliver to the City such undistributed relief funds as <br />there may be at the date of such cancellation, in an <br />amount proportionate to the City's share of poor relief <br />encumbrances within the County relief areas. <br /> <br />IN WITMESS WHEREOF, the parties hereto have set their <br />hands as of the day and date above written. <br /> <br />SIGNATURES <br /> <br /> Section 2.
