District Court of Appeals Case Nos. 56476 and 56477, to wit: <br />"This case is settled and dismissed. Each party shall pay their <br />own costs including attorneys' fees." <br /> <br /> G. Nothing herein shall be construed to limit the <br />authority of Lakewood to undertake any action against any <br />person, including Patrick, in response to conditions which may <br />present an imminent safety hazard to the public. <br /> <br /> H. Patrick and Lakewood hereby waive the entry of <br />findings of fact and conclusions of law under Rule 52 of the <br />Federal Rules of Civil Procedure. <br /> <br /> I. Nothing contained in this Consent Decree shall <br />constitute evidence or an admission or adjudication with respect <br />to any allegation of the Complaint or any fact or conclusion of <br />law with respect to any matter alleged in or arising out of the <br />Complaint or of any wrongdoing or misconduct on the part of the <br />Defendant. <br /> <br /> J. No representations or promises of any kind, other <br />than as contained in this Consent Decree, have ever been made by <br />either party hereto to induce the other party hereto to enter <br />into this Consent Decree. <br /> <br /> XI. CONTINUING JURISDICTION OF THE COURT <br /> <br /> From the date of entry of this Consent Decree the <br />Court shall retain jurisdiction to enforce the terms and <br />conditions of this Consent Decree and to resolve disputes <br /> <br />-11- <br /> <br /> <br />
