Ohio Common Pleas Court Cases Nos. 85026 and 113688, whereupon <br />Patrick filed an appeal in each case and Lakewood filed cross- <br />appeals from such judgments to the Eighth Ohio Appellate Dis- <br />trict Court of Appeals, Cuyahoga County, Ohio wherein such cases <br />remain pending and consolidated as Case Nos. 56476 and 56477 and <br />motions therein for stay orders to enjoin enforcement of Lake- <br />wood's Sign Ordinance pending appeal were denied by both the <br />Common Pleas and Appellate Courts; <br /> <br /> WHEREAS the City has filed its Answer to Patrick's <br />Complaint in the within case, the Court has denied Patrick's <br />Motion for a Temporary Restraining Order, the Court has denied <br />Patrick's Motion for a Preliminary Injunction after hearing, <br />Patrick has appealed the denial of the preliminary injunction to <br />the U.S. Sixth Circuit Court of Appeals wherein an appeal is <br />pending as Case No. 88-4118, and the within case remains pending <br />awaiting decision by the Court on Lakewood's heretofore filed <br />Motion for Dismissal; <br /> <br /> WHEREAS the City and Patrick agree to settle their <br />disputes and litigation by Patrick's permanent removal of the 32 <br />present outdoor advertising structures and installation of six <br />new outdoor advertising structures to be permitted by Lakewood <br />in accordance with the schedule, sites and other details set <br />forth in Exhibit B, attached and incorporated herein by refer- <br />ence, the same as though fully rewritten, and dismissal of all <br />pending state and federal cases, to wit: Patrick Media Group, <br />Inc. v. City of Lakewood, Ohio, et al., Cuyahoga County Court of <br />Appeals, Eighth Appellate District, Appeal Court Case Nos. 56476 <br /> <br />-2- <br /> <br /> <br />
