Public Mearing <br />September 11, 1989 <br />Page 3 <br /> <br />The Board's power and discretion are llm/ted by the Charter and Ord~-nances <br />of the City; and it ~s hnportant that everyone understands ~/~s, as evi- <br />dence which does not relate to the ~ssues before the Board will not be <br />considered in arriving at a decision. <br /> <br />We w/ll now begin with the regular business of ~he Board of Bu/lding S~and- <br />ards. Before I ask the secretary to begin to call ~he docket are there any <br />applicants present who wish at ~his time to have their cases deferred Do <br />another meeting or any questions concerning the rules of this Board. <br /> <br /> Chairman Wright called on Mr. Moran of the Building Department to give <br /> testimony with regards to 1583 Elmwood Avenue. }tr. Moran was sworn in by <br /> Secretary Charles Owen. }ir. Moran proceeded with his ~estimon¥ and stated <br /> ~hat on July 26, 1989, the Building Department received a com~laint with <br /> respect to 1583 Elmwood Avenue. July 26, 1989, Doug Milburn, of ~he Build- <br /> ing Department, responded to the complaint and noted ~en exterior viola- <br /> tions. A letter was sent out to the property owner, ~tr. Joiner, on July <br /> 26, 1989. This letter listed the ~en exterior violations and gave ~r. <br /> Joiner an August 29, 1989 compliance date. <br /> <br /> On August 3, 1989, an inter/or ins~ection was performed on X583 Elmwood <br /> Avenue due to the unsanitary conditions found in the structUre. Mr. Joiner <br /> ~ sent a c~rt~ied letter which stated that he must correct <br /> u~ons or vacate ~ne structure hv a,,~,,, 4, , ...... the viola- <br /> the Building Department -- - ......... ~ g ~acted by <br /> did not ....... fJ . .~ ~u~u~ a,un, property owner Joiner clalme~Ur~ <br /> ~=ueave une certl~lea letter requiring him to vacate the struct <br /> A check with the ~ost office revealed that Mr. Joiner signed for the certi- <br /> fied letter late on August 17, 1989. Mr. Moran then stated that the Build- <br /> ~ng Department gave Mr. Joiner ten more days for compliance to either <br /> vacate or correct the unsanitary conditions listed in the letter. <br /> <br />A follow-up inspection on August 24, 1989 revealed that Mr. Joiner was <br />still occupying 1583 Elmwood Avenue and that none of the violations had <br />been corrected. Mr. Moran further stated that on September 1, ~989, he <br />requested a summons from the Law Department. On September 7, Mr. Moran <br />stated that he visited the property due to the fact that the regular in- <br />spector (Mr. Milburn) was ill. Property owner Joiner would not let Mr. <br />Moran in. Upon leaving the property, Mr. Moran noticed blue smoke and a <br />'horrendous smell' coming from the chimney. The Fire Department was called <br />to the house and they later inspected the house with Mr. Moran. Mr. Moran, <br />however, limited his visit to the living room, dining room and kitchen <br />areas. Me stated that he could only stay ~n the house for 45 seconds due <br />to the incredible stench. Mr. Moran stated that subsequent vlsl%s were <br />made by the Health Department and the Animal Warden. <br /> <br />Upon request from legal counsel, Murman, Mr. Moran was asked to recite the <br />violations listed in the July 26, 1989 letter.
