As [ explained in <br />our conversation, the City of Cleveland Division of Air Pollution Control has <br />been providing services to your community since the early 1970's as the delegated <br />contractual agent for the Ohio EPA. Last year, legal counsel for the Ohio EPA <br />questioned its authority to delegate one political subdivision to act as its <br />agent in another political subdivision. To eliminate any question of the <br />Cleveland agency's authority to act in other communities, the Ohio EPA is now <br />requiring that we contract with those communities in which we provide services. <br />Most of Cuyahoga Count's suburbs will be covered by a contract between the City <br />and the County Board of Health. However, in cities such as yours that have their <br />own health departments, a separate contract is required. You will find in <br />reviewing the contract that your city will incur no additional costs for the same <br />services that we provided during the 1970's and 1980's. What we do need to <br />continue providing these services is 1) execution of the enclosed agreement and <br />2) proof of legislative authority for your city to enter into this agreement. <br />These two items must be accomplished by September 30, 1990. <br /> <br />I will be calling you early next week to follow-up on any questions you might <br />have.
