854/LAM/DSH <br /> <br />AIR POLLUTIOI~ SERVICES AGREEMENT <br />Between <br /> <br /> THE CITY OF CLEVELAND <br /> <br /> And <br /> <br /> CITY OF LAKEWfK)D <br /> <br /> This Agreement for Air Pollution Services (as defined <br />herein) is entered into this day of , <br />1990 by and between the City of Cleveland ("Cleveland") acting <br />through its Director of Public Health and Welfare pursuant to <br />Ordinance No. 2214-89 passed by the Council of the City of <br />Cleveland on , 1990 and the City of Lakewood <br />("Lakewood") acting through its pursuant to <br />Ordinance No. passed by the Council of the City of <br />Lakewood on , 1990. <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the Ohio Environmental Protection Agency <br />("Ohio EPA") has by annual contract delegated authority and <br />provided partial funding to Cleveland's Division of Air <br />Pollution Control ("DAPC") to represent the Ohio EPA throughout <br />Cuyahoga County for the purpose of administering a program for <br />the prevention, control and abatement of air pollution in <br />accordance with the provisions of Chapter 3704 of the Ohio <br />Revised Code, the regulations adopted and orders made pursuant <br />thereto ("Air Pollution Services"); and <br /> <br /> WHEREAS, the Ohio EPA has recently determined that in <br />order for the Ohio EPA to continue to delegate authority to DAPC <br />for Air Pollution Services within Cuyahoga County and outside <br />the city limits of Cleveland, there must be a contract between <br />the local boards of health and the city authorizing the <br />performance of such services within the jurisdictional limits of <br />the local boards of health; and <br /> <br /> WHEREAS, Air Pollution Services are more readily <br />accomplished on a cooperative county-wide basis rather than on <br />an individual city basis; and <br /> <br /> WHEREAS, DAPC is currently operating with competent <br />personrel and adequate facilities for carrying out a <br />comprehensive air pollution control program throughout Cuyahoga <br />County; and <br /> <br /> <br />
