AGREEMENT <br /> <br /> This Agreement is made and entered into by and between the State of <br />Ohio, Ohio Department of Natural Resources, hereinafter referred to as <br />the DEPARTMENT, pursuant to sections 1503.03 and 1501.02 of the Ohio <br />Revised Code, and Lakewood , Ohio, hereinafter <br />referred to as the GRANTEE. <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the GRANTEE has been authorized by.resolution (attached) <br />of its governing body to enter into agreement with the DEPARTMENT for <br />said purpose; and <br /> <br /> WHEREAS, the DEPARTMENT has received federal grant funds from the <br />U.S. Forest Service for purposes of awarding grants to communities who <br />will in turn contract with private businesses to remove, purchase and <br />replant trees in conflict with overhead utility wires on land owned or <br />controlled by such community; and, <br /> <br /> WHEREAS, funds for paying for said services have been encumbered by <br />State Encumbrance Record Number , and are so certified by the <br />Director of the Office of Budget and Management on <br />1992. Obligations of the State are subject to the provisions of section <br />~26.07 of the Ohio Revised Code. <br /> <br /> NOW THEREFORE, in consideration of the mutual covenants by and <br />between the parties hereto, the DEPARTMENT covenants and agrees to pay <br />the GRANTEE a sum not to exceed $ $6,200 for the <br />project enumerated herein. <br /> <br /> The GRANTEE will implement the approved portion of their proposal <br />as submitted in their Municipal Tree Replacement application attached <br />and incorporated herein by this reference. All trees will be purchased <br />from private business contractors. The GRANTEE will provide or be <br />responsible for ~00% of the maintenance for the proposed planting. <br /> <br /> The GRANTEE will submit invoices for reimbursement of allowable <br />costs with documentation, as outlined in the Application Document and <br />Procedural Guide. <br /> <br /> The DEPARTMENT shall provide direction to the GRANTEE. <br /> Work under this Agreement shall not commence until the GRANTEE has <br />officially been notified by the DEPARTMENT to proceed. The DEPARTMENT <br />shall not be responsible for any cost incurred by the GRANTEE prior to <br />receipt of notice to proceed. <br /> <br /> <br />
