Recycler Contract termination, in the event the District is unable <br /> to provide another Recycler, the Political Subdivision may <br /> withdraw from this Agreement upon 30 days notice and/or the <br /> District may terminate this Agreement upon 30 days notice. <br />3. The District may allow up to 5 % of the total ONP, magazines and <br /> <br /> other products delivered pursuant to this Agreement by all Political <br /> Subdivisions, including the Political Subdivision herein, to be used <br /> in the development of new recycling private enterprises which will <br /> utilize such ONP and magazines in the manufacture of new <br /> products 'provided that the Political Subdivisions' requirements for <br /> delivery and the ONP and magazine price formulas applicable to <br /> such Political Subdivisions are not altered. <br /> <br />Rioht to Withdraw. In the event that a Political Subdivision proposes to <br />privatize its municipal collection of ONP and/or magazines such that it <br />has essentially relinquished control of the marketing of. its ONP and <br />magazines, then it may Withdraw from this Agreement upon sixty (60) <br />days notice to the District and to the Recycler. This provision does not <br />allow a Political Subdivision to periodically sell some of its ONP on the <br />open "spot" market to take advantage of market fluctuations in price. <br /> <br />-12- <br /> <br /> <br />
