AGREEMENT WITH RECYCLER FOR RECYCLING OF <br /> . OLD NEWSPAPER AND MAGAZINES IN CUYAHOGA COUNTY <br /> <br /> I.. PARTIES <br /> <br /> This Agreement is between the Board of County Commissioners acting as <br />Trustees of the Cuyahoga County Solid Waste Management Distric~ formed pursuant <br />to R.C. Section 343.01 (hereinafter referred to as the "District") and Packaging <br />CorporatiOn of America, a 'Delaware corporation and a wholly owned subsidiary of <br />Tenneco, Inc. (hereinafter referred to as "PCA" or 'Recycler") and is dated as of <br /> <br /> ii. RECITALS <br /> A. The District, on behalf of various political subdivisions (hereinafter <br /> <br /> referred to as "Political Subdivisions") that .collect old newspaper <br /> {hereinafter "ONP") and/or magazines, has advertised for and received <br /> proposals pursuant to its request for proposals a~ached as Exhibit 1, <br /> from two corporations,' one of which is PCA, a copy of which proposal <br /> is attached as Exhibit 2. The District has determined that the proposal <br /> of PCA, together with modifiCations therein negotiated between the <br /> · parties (the District and the Recycler, the "Parties"), is ~he best and the <br /> Parties desire to enter into an Agreement embodying its terms. <br /> !!!.
