2. The District shall have no liability to Recycler for any breach of <br /> this Agreement and the ReCYcler, which is a third-party beneficiary <br /> of the Intergovernmental Agreement attached hereto as Exhibit 3, <br /> shall look solely to the appropriate Political Subdivision in the <br /> event of a breach by such Political Subdivision. <br /> <br />3. The District may add additional Political Subdivisions or other <br /> entities to this contract in accordance with paragraph IV.F. of <br /> Exhibit 3 attached hereto. <br /> <br />Environmental Compliance. <br /> <br />1. Recycter shall obtain and maintain all necessary siting permits and <br /> licensing, whether federal, state or local. <br /> Recycler shall operate its Recycling Facility in conformity with'all <br /> applicable governmental laws, regulations, ordinances, <br /> restrictions, policies and guidelines.. <br /> <br />.2. <br /> <br />Warranty and Indemnification. <br />1. <br /> <br />Recycler warrants the representations made in .its proposal <br />attached' hereto as Exhibit 2 and shall carry out all actions <br />proposed to be done by it therein except insofar as same are <br />inconsistent with the other provisions of this Agreement. <br /> <br />Recycter shall indemnify and hold harmless the District and <br />Political Subdivisions from, and indemnify, defend and hold them <br />harmless against ail claims, demands, actions, causes of action <br /> <br />-9- <br /> <br /> <br />
