<br /> A RESOLUTION approving a collective bargaining agreement with Lodge 25,
<br />Lakewood Division, Fraternal Order of Police, establishing conditions of employment,
<br />working conditions, various benefits and settling an unfair labor practice charge for cedain
<br />employees of the Depadment of Public Safety, Division of Police, City of Lakewood, and
<br />authorizing the Mayor to sign said agreement on behalf of the City, and
<br />
<br /> WHEREAS, a prior collective bargaining agreement entered into between the City of
<br />Lakewood and Lodge 25, Lakewood Division, Fraternal Order of Police, terminated on
<br />December 31, 1994, and
<br />
<br /> WHEREAS, Lodge 25 filed an unfair labor practice charge against the City with SERB
<br />on December 15, 1994, and
<br />
<br /> WHEREAS, discussions and negotiations have been continued subsequently on
<br />behalf of the City with representatives of Lodge 25, Lakewood Division, Fraternal Order of
<br />Police, with respect to conditions of employment, working conditions, various benefits and the
<br />unfair labor practice charge for certain employees of the Depadment of Public Safety,
<br />Division of Police, and
<br />
<br /> WHEREAS, the tentative agreement reached between the negotiators for the City and
<br />the Union was rejected by the Union membership and the matter was referred to a fact-finder
<br />pursuant to the Ohio Collective Bargaining Act and the unfair labor practice referred to
<br />arbitration, and
<br />
<br /> WHEREAS, the fact-finder's recommendations have been received by the City and
<br />the Union and have been rejected by the Union membership, and
<br />
<br /> WHEREAS, negotiations have continued and a tentative agreement has been
<br />reached between the negotiators for the City and the Union to accept the Fact-Finder's
<br />Report and settle the Unfair Labor Practice charge. AccOrdingly, in order to settle the Unfair
<br />Labor Practice charge, the City will pay to all regular members of the bargaining unit who
<br />were actively participating in the Police Department on January 1, 1995, $1500.00 in 1995.
<br />Further, the City will pay to any regular member of the bargaining unit who is actively
<br />participating in the Police Department on January 1, 1996, $500.00 and to any regular
<br />member of the bargaining unit who is actively participating in the Police Department as of
<br />January 1, 1997, $500.00 in 1997. These payments represent a total and complete
<br />settlement of the Unfair Labor Practice charges against the City.
<br />
<br /> WHEREAS, this Council determines that it is in the best interest of the City to accept
<br />and approve the fact-finders report, proposed agreement and settlement of the unfair labor
<br />practice charge, and authorize the Mayor to sign the contract on behalf of the City of
<br />Lakewood; now, therefore,
